This Circular, consisting of 13 articles divided into four Chapters, guides a number of articles of the Government’s Decree No. 34/2014/ND-CP of April 29, 2014, promulgating the Regulation on land border areas of the Socialist Republic of Vietnam. This Circular applies to Vietnamese and foreign agencies, organizations and individuals operating in land border areas of the Socialist Republic of Vietnam (below referred to as land border areas). Land border areas are defined in Clause 1, Article 3 of Decree No. 34/2014/ND-CP.

This Act may be cited as the Immovable Property (Tenure, Registration and Valuation) (Amendment) (No. 3) Law of 2016 and shall be read together with the Immovable Property (Tenure, Registration and Valuation) Law. Amendments deal with adminstrative and legal proceedings for land leasing. Article 2 of the basic law is amended by adding the following new terms and definitions of "government settlement".

Il s’applique à l’ensemble des terrains non titrés ni cadastrés occupés, que ces derniers soient urbains ou ruraux, sous réserve des dispositions des autres textes soumettant certains terrains à des régimes particuliers.

This Act amends the Shooting and Fishing Leases Act by replacing section 18. That section grants power to the Minister to make regulations for the purposes of this Act, and, in particular, but without prejudice to the generality of that power, may make regulations – (a) for the levying of charges and the taking of fees; (b) amending the Schedule. Regulations made under this section may provide that any person who contravenes them shall commit an offence and shall, on conviction, be liable to a fine not exceeding 20,000 rupees and to imprisonment for a term not exceeding one year.

Guideline No. 1 dated 9 June 2016 on the rules and procedures for examining and approving lease requests for the use of public pasture and forestry funds.

The Guideline provides for areas of the public forestry and pasture fund that may be leased according to the public competition/bidding procedures. The forestry authorities assess the forestry and pasture areas at the beginning of the year and submit the proposed list of leases to the municipality together with a detailed report on their potential use. The leases should comply with the law requirements regarding the allowed activities as well as the long- and short-term management plans.

This Regional Law sets forth the modalities of allotment free of charge of public or municipal land plots to citizens with three and more children underage for smallholding, individual construction, horticulture and gardening, and establishes maximum and minimum land areas of the aforesaid land plots. The right of allotment shall be granted in accordance with the following criteria: (a) nationals of the Russian Federation; (b) residence on the regional territory for the last three years; and (c) in need of improved housing conditions.
