Waste and Soil Protection Competences Ordinance.

The present Ordinance lays down provisions relating to the distribution of competencies among the various bodies dealing with waste and soil protections issues. The Annex lays down in details authorities competent for specific administrative services renders, such as, for example, finding adequate places to stock waste, authorizing the building and functioning of such a deposit, transfer of waste management and waste disposal to third parties. The text consists of 5 articles and 1 Annex.

Delegation of powers under the World Heritage Convention Act (Notice No. R. 723 of 2002).

With this Notice, the Minister of Environmental Affairs and Tourism delegates powers vested in him other by section 43(1)(a) of the World Heritage Convention Act in Director-General of the Department of Environmental Affairs and Tourism. The powers delegated include authorization and ratification of land claims negotiations and settlement agreements entered into by the Greater St. Lucia Wetland Park Authority in respect of state or private land forming part or affecting World Heritage Sites and of land acquisitions made by the Authority.

Act establishing the State Fund for Soil Improvement.

This Act sets up the State Fund for Soil Improvement. It also lays down amendments to the the Act on conditions of converting agricultural and forest lands from ownership of the state to other persons and to the Agriculture Law. As from 1 January 2006, the State Fund of Soil Improvement takes over the rights and obligations pertaining to the Ministry of Agriculture in matter of soil improvement.

Agricultural Agreement.

The present Agreement between the Länder Brandenburg and Berlin lays down provisions relating to matters concerning agriculture of both Länder. Article 1 establishes that the highest authority for agriculture of Brandenburg is also responsible for the implementation of the agricultural promotion programme of the European Union in the Land Berlin.

Regional Act No. 22 promoting the use of compostable wastes and soil conditioners to protect soil quality.

With a view to improving soil quality and preventing desertification, this Regional Act encourages the use of compostable wastes and soil conditioners. To this end, the regional authority grants subsidies for (i) the purchase of compostable wastes and soil conditioners and (ii) the implementation of techniques aimed at the conservation of organic compounds. The Act defines the conditions under which farmers may benefit from those subsidies. Further provisions concern the monitoring of quality of soils in Abruzzo.

The purpose of this Act is to support the decentralization process in general and capacity building of the districts, in particular with respect to the rural infrastructure development, and to improve rural accessibility.Village Development Committees shall be constituted as executives of the Village Council in village development areas, Municipalities shall be constituted as executives of the Municipal Council in municipal areas, and District Development Committees shall be constituted as executive bodies of District Councils in district development areas.

The present Law implements the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). Article 1 of the present Act establishes that the party who caused a harmful soil change or a contaminated site, and his universal successor, as well as the relevant property owner and the occupant of the relevant real property, shall be obligated to notify this to the competent authority.

Foreshore and Land Reclamation (Amendment) Act 2005 (No. 7 of 2005).

This Act amends the Foreshore and Land Reclamation Ordinance, Cap 35 in section 2 by adding definitions and in section 3 with respect to compensation by licence holders to landowners.This amendment is introduced so as to strengthen the recognition of customary rights over the foreshore of lands. Private rights over land expressly include customary rights to the exclusive use of the foreshore of Mauritius lands. Landowners are granted certain rights with respect to the granting of licences for the extraction of materials from the foreshore.
