The scope of Land Code shall be to regulate land relations originating from application of different types of land ownership rights, including duties of landowners, tenants, leaseholders, protection of land rights, application of rational land tenure, restoration and improvement of soil fertility, land re-cultivation and improvement of natural environment. Land property shall envisage public, municipal and private ownership, that have equal status and are equally protected by the Law (Art. 4).

This Law establishes legal, organizational and financial principles of regulation of social relations dealing with expropriation of land plots in private ownership for public needs. Expropriation shall be performed through buy-out and payment of compensation to the owners of expropriated land plots. Expropriation and buy-out shall be performed in accordance with the acting legislation. Buy-out price shall include inconvenience and losses of the owner of the plot of land subject to expropriation and land price shall be fixed by the local self-government.

This Act contains special provisions regarding the rights of neighbouring real estate proprietors. Real servitude and the right of use are provided for as well. For all the issues related to the use of real estates and not covered by this Act, the provisions of the Civil Code shall be applied.

La presente Resolución aprueba la Directiva que regula el procedimiento para la inmovilización temporal de las partidas de predios, que implementa un mecanismo de seguridad de inmovilización que tiene por objetivo generar el cierre temporal de la partida registral referida a un predio, hasta cumplir con un procedimiento especial de verificación de la autenticidad de títulos, o hasta que opere la caducidad del asiento de inmovilización, a fin de resguardar los derechos inscritos.

El presente Decreto Supremo aprueba el Reglamento de Organización y Funciones (ROF) de la Superintendencia Nacional de los Registros Públicos (SUNARP), con la finalidad de efectuar una redistribución de los órganos que conforman su estructura organizacional y, de esta manera promover la inclusión de los servicios registrales a la población en general y, en especial a la población más vulnerable, procurando con ello una gestión más eficiente acorde con la demanda ciudadana.

Deeds and Land Registry Act (Cap. 79).

This Act makes provision for the registration of instruments affecting land and other matters relating to registration of titles in land and the proof of instruments. It continues the existing Deeds and Land Registry and defines functions and powers of the Registrar. The Act specifies the Instruments that not need to be registered. An instrument shall not be registered unless it is proved in the manner described and provided for in this Act. The Act also concerns the registration of wills.

Item 5.4² shall be amended to add the following wording: “In the name of the Russian Federation shall apply for state registration of property right of the Russian Federation to land plots required for marine harbour and fluvial port facilities and infrastructure of inland waterways of the Russian Federation, and also of other ownership rights to such sites that is recognized (is originated) in accordance with the federal laws”.

These Rules amend the Land Registration Rules 2012: on the acquisition of easements and profits by prescription (rule 46); in the provisions for the registration of judgment mortgages pursuant to Section 116 of the Land and Conveyancing Law Reform Act 2009, to specifically include judgments of the Supreme Court, provide for the registration of judgment mortgages in execution of judgments of the courts of Member States of the European Community; add new Forms 60A and 60B to the Schedule; modify Forms 3, 17, 37, 38, 39, 64, 84 and 96.
