The present Law lays down provisions relating to official land survey and land cadastre in the Free State of Saxony. Article 1 establishes that the official land survey includes the: a) land survey; 2) land cadastre including cadastre survey and marking and 3)binding evidence of real-estate boundaries. The text consists of 30 articles divided into 4 Parts as follows: General provisions (1); Data (2); Publicly appointed surveyors (3); Penalties, Ordinances (4).

The purpose of the present Ordinance is to enforce efficiently the Saxon Land Survey and Cadastre Law of 29 January 2008. The text – consisting of 22 articles – deals, inter alia, with the following aspects:announcement of land survey works, access to information, use of information from land survey database, requirements of the survey cadastre, border of parcels of land, marking, control of lower survey authorities, transfer of data, transitional provisions, entry into force and expiry.

The present Ordinance implements the Federal Land Register Ordinance in its version of 26 May 1994 (BGBl. I p. 1114). In particular, the Ordinance lays down provisions relating to a computerized land register in the Free State of Saxony. The contracting parties of the present Treaty (the Free State of Saxony and the Land Sachsen-Anhalt) shall cooperate in the operation of all matters concerning land use planning and spatial planning in the area of Halle – Leipzig. The text consists of 10 articles divided into 4 Parts as follows: Purpose of the Treaty (1); Cooperation of the Länder (2); Cooperation of competent authorities (3); Final provisions (4).

This Act concerns limitations applying to legal action such as actions of contract and tort; actions to recover land, registered title and rent; actions to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; actions in respect of trust property or movable property of deceased person; and actions against the government and public authorities, etc. The Act also concerns the application of limitation law to arbitration, the acquisition of easements and registration of title to land or easement acquired under Act.

These Regulations amend the Land Survey Regulations by inserting a new table of contents and in regulations, 1, 4, 10, 11, 13, 19, 20 and 21. The amendments mainly concerns methods of measurement and survey, procedures for temporary and final approval of a survey by the Surveyor-General and connection of a survey to the National Co-ordinate System.

These Regulations implement provisions of the Land Survey Act with respect to, among other things: field measurements and observations; connection to the National Control Survey System; manner and methods of survey; marking; testing of survey by the Surveyor-General; general plans; and arbitration proceedings.

Article 4 shall be amended to add the following wording: “In accordance with Civil Code each land parcel shall be attributed address permitting to determine its location without special means”.
