Ce Code domanial et foncier porte le statut juridique du sol. Basé sur les principes socialistes, il affirme la propriété du peuple représenté par l'Etat sur la terre. L'Etat possède la pleine et libre disposition du sol, du sous-sol et des ressources naturelles. La propriété privée n'existe que sur les mises en valeur du sol et sur les investissements. Au bout d'une certaine période, l'abscence de mise en valeur justifie un retour au domaine. Sont aussi abolis les droits fonciers coutumiers.

This Regional Law regulates land tenure and land protection. It establishes minimum and maximum area of agricultural land that can be allotted to citizens out of the stock of public and municipal land: (a) for peasant farms – from 0.04 ha to 0.50 ha; (b) for gardening - from 0.04 ha to 0.50 ha; (c) for horticulture - from 0.04 ha to 0.50 ha; (d) for stockbreeding - from 0.04 ha to 30 ha; and (e) for construction of suburban cottages - from 0.04 ha to 0.50 ha.

The Premier decrees that Federal Agency of Cadastre of Immovables is federal executive body authorized to carry out functions regarding rendering state services, management of state property and law enforcement functions in the sphere of land survey, state cadastre valuation of land and state monitoring of land. The Federal Agency of Cadastre of Immovables is under the jurisdiction of the Ministry of Economic Development and Trade.

Article 5 shall be amended to add the following wording: “Multi-child family seeking allotment of a land plot for subsidiary smallholding must indicate in the application the location of the land plot in question within the boundaries of inhabited area (smallholding) or outside inhabited area (field land plot)”.

Law on transfer of land into ownership for agricultural production.

The present Law establishes the legal basis for transfer of land into ownership of citizens for agricultural production in conformity of the provisions of land reform. Public land can be transferred into ownership exclusively to the Turkmenistan nationals. Foreign citizens or stateless persons can have access to land resources on condition of lease (art. 2) Land can be transferred into ownership to the households of peasants’ associations for agricultural production.
