This analysis and recommendations stem from USAID/Kenya’s request for an assessment of Kenya’s draft National Land Policy (dNLP).4 It was conducted under the global task order: Property Rights and Resource Governance Program, a mechanism designed and supervised by USAID-EGAT’s Land Resources Management Team under the Office of Natural Resources Management.

The approval by the public of the Constitution at the referendum on August 4, 2010 and its promulgation on August 27, 2010 heralded a new dawn of governance in Kenya. Through its broad provisions, it is expected that it will spur social and economic development and secure the land rights of all Kenyans, by among others guaranteeing them ownership, control and access to natural resources.

The first set of the land laws were enacted in 2012 in line with the timelines outlined in the Constitution of Kenya 2010. Most of the land in sub-Saharan Africa is governed under various forms of customary tenure. Over the past three decades a quiet paradigm shift has been taking place transforming the way such landl is governed. Driven in part by adaptations to changing context but also accelerated by neo-liberal reforms, this shift has created a ‘new’ customary tenure in sub-Saharan Africa. This paper reviews some of the evidence and analyses the ways in which this neo-liberalisation of customary tenure has been transforming relations of production and how land is governed in sub-Saharan Africa.

Securing Land Transactions with Biometric data in Ghana

There is a gap between land tenure and the physical land giving room for impersonation, multiple allocation and sale of plots, loss of possession, land racketeering and fraud through forgery. Hence, the need to identify unambiguously parties involved in land transactions so that the root of title can be traced to ensure tenure security. This paper explores innovative ways of filling the gap with biometric data to secure land transactions.

The Influences of Gendered Customary Land Tenure System on Food Security in Nandom District, Ghana

Food insecurity has been a major global development concern. Hence, SDG Two seeks to achieve Zero Hunger by 2030. The situation is severe in sub-Saharan Africa, where customary practices deprive women of land ownership and limit their access rights. This paper explores the influences of a gendered land tenure system on food security in Nandom District, adapting conditional assessment modules defined by USDA and FAO. With a list of households categorized under headship, 30 respondents were proportionally selected from each of the four study communities.

According to a 2008 World Bank Report, Uganda is among the countries with the youngest population and the highest youth unemployment rate of 83%. During the reading of the 2011/2012 budget of Uganda, the then Minister of Finance recognized that because of the high levels of unemployment, the Ugandan economy can only absorb 20% of its youth. Owing to this, this demographic has often been described as a ticking time bomb waiting to explode.The above notwithstanding, Uganda is blessed with an abundance of land and land-based resources which remain largely underutilized.
