These Regulations amend the Land (Duties and Taxes) Act in the Second Schedule by adding at the end of the Schedule a note on the definition of the date of transfers of specified transactions of purchase, including transfer by a lessee who is the holder of a new lease pursuant to section 6(1E) of the State Lands Act or section 10(3B) of the Pas Géométriques Act. Schedule 2 specifies rates for purposes of section 4(4) of the principal Act.

Regional law No. 244 “On allotment of agricultural land to citizens for haying and grazing”.

This Regional Law establishes the conditions for allotment of parcels of public or municipal agricultural land on lease to citizens for haying and grazing. Agricultural land parcels shall be allotted to citizens on condition of ownership of agricultural animals thereby. Minimum land area shall be 5 ha. Common access land areas, waterbodies and parks shall not be allotted for haying and grazing. Planting of perennial timber species and shrubbery, and also timber extraction shall be prohibited on land areas allotted for haying and grazing.

This Act amends the Leases Restrictions Act 1976 in section 2 by the defining "Minister" as the Minister of Justice. It also redefines the functions of Leases Approval Tribunal, repeals section 6 inserts a new section by stipulating that nothing in the Unit Titles Act 2005 shall affect the principal Act.

La présente loi a pour but d'assurer l'exécution, sur le territoire de la République et Canton du Jura, de la loi fédérale susvisés sur le bail à ferme agricole. L’article 2 établit que les dispositions de la loi fédérale sur le bail à ferme agricole sont applicables: a) aux immeubles affectés à l'agriculture; b) aux entreprises agricoles; c) aux entreprises accessoires non agricoles mais formant une unité économique avec une entreprise agricole.

These Regulations, for purposes of section 4 of the Africans on Private Estates Act, prescribe forms for: the register of resident Africans; the document certifying registration; and the register of Africans entering an estate under special agreements. The Regulations also specify particulars that shall be included in the registers.

Regional Law No. 39-ZO “On rates of payment of forest fees”.

This Regional Law establishes rates of payment for short-term forest management of forest fund (public forest) and for calculation of lease payment for lease of land plots under forests. The following activities shall require compulsory payment: (a) timber extraction (applicable to standing timber); (b) procurement of non-timber forest products; (c) agro-forestry; (d) forest management for hunting, tourism, sport and other recreational forests.

The Act requires landowners to register Africans residing on their estate for the purpose of growing any economic crop for sale or performing any agricultural work. “African” means any person who is a member of an African community indigenous to Malawi, Tanzania, Zambia or Mozambique. This Act shall not apply to any African who is in occupation of land on an estate by virtue of a valid lease or tenancy agreement for a period of not less than two years.

The Act makes provision for the registration of title in land and related matters. The Act also defines characteristics of various rights in land, sets out the effects of registration if title in land and provides for the acquisition of land by prescription.As for the administration of land registration, there shall be land registry offices and officers for each registration district. The Act also concerns co-proprietorship and partition.

This Regional Law regulates some issues related to turnover of agricultural land, including agricultural land parcels and agricultural land shares in common ownership of agricultural land. It shall not be applicable to agricultural land parcels allotted to citizens for subsidiary smallholding, gardening, horticulture and cattle breeding.

This General Notice, made under section 6 of the Deeds Registration Act, exempts all leases, tenancy agreements or licences for the occupation of land granted by the Malawi Housing Corporation or the Capital City Development Corporation where the term granted does not exceed 364 days, from the requirement of registration as provided for in the Act.

The Act provides that all deeds, conveyances, wills and instruments in writing whereby any land or interest in or affecting land other than land registered in accordance with the Registered Land Act, may be affected shall subject to compulsory registration in the Deeds Registry Office. The Minister may exempt certain leases from this requirement.

Delegation of Powers Order made under the Land Act (Cap. 57:01).

This Order, made under section 41 of the Land Act, delegates powers assigned to the Minister under that Act to the Commissioner for Lands. The Commissioner for Lands shall administer the Land Act and shall have specified powers in respect of, among other things: grants, lease or other dispositions in accordance with section 5 of the Act, grants, lease or other dispositions affecting public or customary land and agreement or licences in respect of the control or use of running or stagnant water.
