Occupiers' Liability Act.

This Act defines the liability of an occupier of premises for injury to persons or damage caused to goods and resulting from actions or omissions of the occupier in respect of the occupied property. The Act also defines the liability of a landlord under the obligation of maintenance or repair of the occupied property.

Settled Land Act.

This Act sets out rules for the sale, partition, lease, administration by trustees, mortgaging, exchange, etc. of settled land and certain rights related to the use of such land. The Act sets out criteria and definitions as to what land is considered settled land. It defines the right of a tenant for life in respect of such land including lease of land for mining purposes. The Act sets out certain rules applicable to mining leases.

This Instruction establishes the structure of state land cadastre that consists of four sections: (a) register of natural persons; (b) register of legal persons; (c) register of the objects of property, including use restrictions such as lease holders, pledgers and preferential terms of land management; and (d) register of documentation.

Ordinance on alpine farms (Alpine Management Ordinance).

The purpose of the present Ordinance is to regulate the cultivation and management of alpine regions and the related existing rights of lease and preemption thereof. The kind and extension of the cultivation and management shall be carried out according to ecological principles. In such a way a sustainable development of agricultural land shall be guaranteed and a wide plant variety shall be promoted. Typical endemic plant societies shall be conserved.

This Presidential Decree, in order to improve the efficiency and quality of vegetable, fruit and grape processing and to increase their export, mandates that the procedure for creating reorganized farms on cultivated areas of horticulture, fruit growing or viticulture cooperatives shall be run by a special commissions through open tender. Preferential rights shall be granted to cooperative members who have worked on the land in question under household contracts.

The present Land Code regulates land relations and is aimed at the creation of conditions for rational land tenure and soil conservation, reproduction of soil fertility, conservation and improvement of environment for the purpose of the equal development of all forms of economic activity. Land is the property of the state. Citizens have the right to allocation of a plot of land terms and conditions of which shall be determined by the present Act (art. 2).

The present Regulations provide for the enactment of the Forest Resources Management Act. In particular, the Regulations lay down provisions relating to Crown resource land referred to in :a) The Forest Resources Management Act; b) The Provincial Lands Act; c) The Natural Resources Act. A licensee within the meaning of the Forest Resources Management Act shall obtain a resource land disposition to use or occupy Crown resource land for the purposes of a processing facility, camp, mill site, timber storage area, quarry, or sand and gravel pit.

The present Regulations provide for the enactment of the Provincial Lands Act. The present Regulations enact section 11 of the Oil and Natural Gas Act. For the purpose of the present Regulations “bid” means a proposal for exploration or development of provincial lands for oil or natural gas, that was submitted in response to a call for bids. Section 2 establishes that the Minister may issue a call for bids for an oil and natural gas permit: a) for any provincial lands; or b) for all or part of provincial lands described in a request submitted pursuant to subsection. The text consists of 27 sections.

Order No. 80 of the Ministry of Agriculture and Food on use of reclaimed land of the blackland region for grazing.

This Order authorizes specialized organization “Agrolesomeliostroy” subordinated to the Ministry of Agriculture and Food to allot drained pastures of the blackland region on lease for grazing for the period of five years and to conclude lease contracts. Priority lease right shall be granted to farming enterprises which land has been expropriated for the period of drainage and land reclamation. The Order contains the form of model contract for lease of reclaimed land of the blackland region for grazing.
