This Governmental Decree regulates the issues of constitution, modification of category, validation of boundaries and cancellation of protected areas. Protected areas shall be classified as follows: (a) state nature reserves; (b) state natural parks; (c) state nature monuments; (d) state nature reserves; (e) state botanical gardens, dendrological and zoological parks; (f) biosphere reserves; and (g) transboundary protected areas. Protected areas shall be constituted with the consideration of ecological, scientific and economic substantiation, and also historical and cultural value.

This Regulation sets forth the procedures and principles of determination, registration, approval, change and announcement of natural sites, special environmental protection areas and natural assets. The objectives of this Act are, inter alia, to: (a) provide for, the cultural and environmental protection and sustainable development of, and related activities within, World Heritage Sites; and giving effect to the values of the World Heritage Convention; (b) make the Convention part of South African domestic law and to create a framework to ensure that the Convention and the Operational Guidelines are effectively implemented in the Republic; (c) ensure that everything done in terms of this Act conforms with the obligations of the Republic in terms of the Convention and the Operational Gu

The Act consists of 125 sections divided into 5 Parts: The Environment Agency and the Scottish Environment Protection Agency (I); Contaminated Land and Abandoned Mines (II); National Parks (III); Air Quality (IV); Miscellaneous, General and Supplemental Provisions (V).The Environment Agency and the Scottish Environment Protection Agency are established as a body corporate. The Environment Agency shall inherit functions of the various environment protection authorities including the National Rivers Authority and the London waste Authority, both abolished by this Act.
