The Government, for the purpose of securing and transfer of the plots of urban land and the plots of land of other settlements on conditions of ownership, possession, lease of natural and legal persons, as well as for the purpose of their registration, taxation and transaction, decrees to validate the Regulation and to recommend the bodies of the local self-government to set up in case of necessity special commissions for the determination of the boundaries of land tenure. The Regulation is aimed at the solution of the following problems: 1).

This Act provides the procedure and principles for land readjustment. The document consists of 5 Chapters that contain 35 Paragraphs. The provisions of the Administrative Procedure Act (RT I 2001, 58, 354; 2002, 53, 336; 61, 375) apply to the administrative proceedings prescribed in this Act, taking account of the specifications provided for in this Act.

Investment projects for the construction of infrastructures both in the urban and rural areas (such as irrigation works, water supply, drainage etc. etc.) shall be allowed the use of land funds or allocated auctioned lands. Bidding procedures are listed in Article 5, requisites for land auctions in Article 6.

The Ordinance provides for planning projects in order to improve the use of lands, their redistribution, the erection of infrastructures and further advance the development of urban areas.

This Decree is composed of 4 articles. Materials abstracted from the natural subterranean deposits and reservoirs situated in the public and private lands into the Syrian Territorial such as construction, installation, ornamental and industrial materials exploited in the private sector and joint sector excluding materials used for owner houses shall be subjected to the State rights according to article 12 of Law No. 20 of 1991 (art. 1).

Land taken by the Government is declared to be confiscated land and any irregularities in acquisition shall be resolved through procedures under the Land Adjudication Act. Section 5 concerns easements on banks of waterways.

The Law provides for water rights and water charges appliable to the owners of parcels of land within the area of the Kajakai and Arghandab dams. Both rights and water purchase are estimated on the acreage.

Part I, Management of forests and forested lands: provisions are made on social and community forestry in order to preserve, manage, maintain, rehabilitate forests and forested lands by maen of strategic planning, appointing Directors of Forestry to organize, supervise and implement the plans, encouraging investments in forestry industrial production.

The Law provides for all the activities related to mining and exploiting the mineral resources, be them gemstone (ruby, diamonds, opal, sapphire etc.), metallic mineral (iron, gold, silver, zinc, copper, aluminium etc.), industrial mineral (coal, asbestos, etc.) and stone (marble, limestone, quartz, granite etc.). Large scale-production is encouraged as the exportation of mineral products.

The newly instituted Survey and Demarcation Division shall conduct the survey and definiton of boundaries of the so called reserved Forests of Bhutan and shall widely spread information about the forest areas included under this provision, in order to ascertain eventual claims of rights on forests and their products, land and water courses or grazing and pasture rights. The involved land shall be excluded from the reserved forest areas or expropriated or acquired.

The Measures are formulated in accordance with the 9th article of the Land Law of Tai Wan, are divided into V Parts: General Provisions (I); Cadastre (II); the Land–use Right (III); Land Tax (IV); and Expropriation (V). The Measures provide for the systematic surveying of the land, the criteria of the land tax and the procedures for the expropriation of the land.
