Local Government (General) Regulations, 2005.

These Regulations implement provisions of the local Government Act 1993.The Regulations, among other things, provide for the compulsory acquisition of land by the council for purposes that include the extension of public land, establishment of drainage systems and waste management facilities, and the establishment of works for the prevention and control of floods.The Regulations provide for: elections of mayor and deputy mayor by councilors; code of conduct; procedures to be followed by Code of Conduct Panel and Standards Panel; public tenders for goods and services, and contracts; etc.

Regional law No. 142-ZS amending Regional Law No. 147-ZS “On minimum and maximum land parcels of public and municipal land that can be allotted to citizens for gardening and horticulture”.

Article 1 shall be amended to add the following wording: “This Regional law establishes that maximum land parcels of public and municipal land that can be allotted to citizens for subsistence farming on condition of ownership or other types of land tenure shall be 2, 5 ha and on urban land for horticulture 0,5 ha”.

Amends: Regional Law No. 147-ZS “On minimum and maximum land parcels of public and municipal land that can be allotted to citizens for gardening and horticulture”. (2006-12-29)

The present Regulations are made under the Federal Real Property and Federal Immovables Act. The Regulations give ministers the power to enter directly into transactions related to acquiring, disposing, optioning, licensing, transferring administration and transferring administration and control of real property. Furthermore, the Regulations give ministers the legal authority to make certain payments related to acquiring real property and impose certain controls, primarily related to title certification, on the full or partial payment of the purchase price.

The present Regulation is enacted under the Public Lands Act. In particular, the Regulation lays down provisions relating to the resolution of disputes. At the outset the Regulation contains, inter alia, the definition of certain terms such as, “agricultural disposition”, “agricultural disposition holder”, “agricultural lease”, “agricultural leaseholder”, “Board”, “exploration”, “exploration approval”, “local settlement officer”.

The present Regulation is enacted under the Public Lands Act. Section 2 establishes that in n addition to the purpose in section 11.2(2)(a) of the Act, the Fund may be used for the following: a) to provide grants made by the Minister under the Environment Grant Regulation (AR 182/2000); b) to pay for expenses that are directly associated with the sale of public land referred to in section 11.2(3) of the Act. The text consists of 5 sections.

State Lands (Amendment) Decree 2013 (No. 7 of 2013).

This Decree amends the State Lands Act, originally titled “Crown Lands Act”, in section 6 by adding a subsection (6), which provides that any i Taukei land which is exchanged for portions of State land under subsection (3) must not be exchanged for portions of private freehold land under subsection. It also adds a new section (28a), which allows a person who is not a registered surveyor to be appointed as the Director of Lands.

Mahogany Industry Development Decree 2010 (No. 16 of 2010).

This Decree establishes the Mahogany Industry Council and provides for the continuation of the Fiji Mahogany Trust, which was established as a body corporate under section 5 of the Fiji Mahogany Act 2003 for the benefit of landowners and the Fiji Hardwood Corporation Limited, transformed into a privatised Company for the purposes of developing the mahogany industry in Fiji, including the harvesting and processing of mahogany forests.

Regional Law No. 422-OZ “On allocation of land parcels in ownership to citizens free of charge”.

This Regional Law establishes the modalities of allocation of parcels of public land to citizens free of charge for gardening, horticulture and stockbreeding, and establishes minimum and maximum land area of the aforesaid parcels. It establishes that regional resident – natural person that has never had nor has parcel of agricultural land in ownership for subsistence farming, gardening or horticulture, shall be granted the right to receive in ownership a land parcel for each of the aforesaid purposes once-only.

East Side Traditional Lands Planning and Special Protected Areas Regulation (Man Reg. 149/2010).

The present Regulation is enacted under the Muskwa Kechika Management Area Act. In particular, the Regulation lays down detailed provisions concerning the Muskwa Kechika Management Area. The text – consisting of 10 chapters – deals with the following aspects: approval of forest development plans, renewable or replaceable agreements and permits, General Management Direction, special resource management zones, protection resource management zones.
