Regional Law No. 187-OZ “On municipal land-use planning”.

This Regional Law regulates the issues of land-use planning of municipal units, the modalities of elaboration and composition of the required documentation. Municipal land-use planning scheme shall include: (a) general map; (b) maps (schemes) of functional areas; (c) mapping of the boundaries of territory and landmarks; (d) scheme of restricted use land areas; and (e) scheme of infrastructure.

The present Regulation enforces the Public Lands Act. In particular, the Regulation lays down provisions relating to the authorization of activities carried out for recreational purposes, such as, hunting, fishing, camping, boating, hiking, bicycling, the use of motor vehicles, etc. The text consists of 26 sections divided into 4 Parts as follows: Access for recreational purposes (1); Dispute resolution (2); Miscellaneous (3); Expiry and coming into force (4).

The present Regulation enforces the Planning Act. The Regulation reflects the provincial government’s interest in land and resource use and sustainable development, and provides policy direction for a comprehensive, integrated and coordinated approach to land use planning. The Regulations serves as a guide to planning authorities in preparing, reviewing and amending development plans and regional strategies. In particular, the text lays down provisions relating to provincial land use policies, development plan requirements and livestock operations requirements.

This Regional Law establishes price of agricultural land pertaining to public or municipal property, minimum lease period thereof, and procedure of conciliation on location of agricultural land plots allotted as land share in common land property. Minimum lease period for arable land, hayfield, pasture and other categories of agricultural land shall be 3 years.

Regional Law No. 23-RZ “On turnover of agricultural land”.

This Regional Law shall be applicable to turnover of agricultural land pertaining to public or municipal property. Privatization of agricultural land pertaining to public and municipal property can be performed 49 years after the date of entry into force of this Regional Law. Distant pastures shall be excluded from privatization. Agricultural land parcels can be expropriated from the owners if it remains unused or non-purposefully used for the period of three years.

Quarriable Substances Act (SNB 1991, c Q-1.1).

The present Act concerns the operation of mines, other than coal. Quarriable substances are vested in the owner of the land in or on which they lie. The Minister of Natural Resources controls the extraction of quarriable substances from Crown Land and that area of the shore that lies within three hundred metres above and three hundred metres below the ordinary high water mark.

The present Regulation enacts certain sections of the Quarriable Substances Act (SNB 1991, c Q-1.1). The text – consisting of 28 sections – deals, inter alia, with the following aspects: shore areas, quarry permit, quarry lease, peat exploration licence, peat lease, written authorization, renewal of quarry lease or peat lease, fee for transfer of quarry lease or peat lease, protection, reclamation and rehabilitation.

Crown Land Management Regulations 2010.

These Regulations, consisting of seven sections completed by two Schedules, implement sections 25, 27 and 61 of the Crown Land Management Act 2009 by prescribing: circumstances in which the disposal of Crown land by transfer or grant of the fee simple does not need to be by public auction, public tender or other open competitive process; land included in the Adelaide Park Lands to be Crown land; and unlawful occupation of Crown land during the period of three weeks to be an offence.

Beaches Regulations (N.S. Reg. 70/89).

The present Regulations are made under section 13 of the Beaches Act. The Regulations lay down provisions relating to the safeguard of beaches. Section 4 establishes that the the Minister may enter into a management agreement with the owner or occupier of land adjacent to a beach. Section 7 lists activities which are prohibited on a beach, such as remove mineral, fossil, sand, gravel or other object of natural interest. The text consists of 15 sections.
