The present Final Agreement between the Government of Canada, the Vuntut Gwitchin First Nation and the Government of the Yukon is made under article 35 of the Constitution of Canada and sets out the rights of the First Nation Vuntut Gwitchin and its people and in particular ways in which the federal, territorial and First Nation governments interact.

Article 4 shall be amended to add the following wording: “Supreme regional state executive body in the sphere of land relations shall be responsible for listing of precious particularly productive agricultural land areas, including agricultural land of experimental and production units of scientific research organizations and experimental farms of educational institutions, the use of which for other purposes shall be prohibited”.

In the Annex item 4.2 shall be amended to add the following wording: “Decision on allotment of plot of public land free of charge to multi-children family or on refusal of such allotment shall be made by the regional executive body authorized by the Regional Government in accordance with the rules set forth by the Regional Government”.

Article 8 (5) shall be amended to add the following wording: “The right to once-only allotment free of charge in ownership of land plots for gardening, horticulture or peri-urban agriculture shall be granted to citizens having already in actual use the aforesaid plots of land. The aforesaid plots of land pertain to low-yielding and disturbed land”.

The present Regulations are made under the National Parks Act. In particular, section 3 establishes that the Minister may, for any term not exceeding 42 years and on such terms and conditions as the Minister thinks fit, grant leases of public lands, inter alia, a) in the Town of Jasper, visitor centres and resort subdivisions for the purpose of residence; b) in the Town of Jasper and visitor centres for the purposes of trade, tourism, schools, churches, hospitals and places of recreation or entertainment.

The Contracting Parties, Her Majesty the Queen in Right of Canada, the Selkirk First Nation and the Government of the Yukon have developed the present Plant which identifies certain activities to be undertaken and certain payments to be made with respect to the implementation of the Selkirk First Nation Self-Government Agreement.
