Article 6 shall be amended to add the following wording: “Plots of public land, owned by the Regional Administration, shall be allotted to natural and legal persons in ownership or lease, and also, in cases envisaged by Land Code of the Russian Federation, in permanent (open-ended) tenancy, free of charge”.

This Law regulates relations concerning ownership, land tenure, and disposal of agricultural land, and also land shares in common property, establishing plenary powers of regional administration and local government in the sphere of turnover of agricultural land. It lays down terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property. Agricultural land shall be used exclusively for agricultural production. Privatization of agricultural land shall start from the date of entry into force of this legislative act.

This Regional Law regulates some relations concerning turnover of agricultural land and land shares in common property. Minimum consolidated land plot shall be equal to 5, 0 ha. Maximum agricultural land plot area that can be owned by a single household or by a single legal person within a single administrative unit shall be twenty percent of total available agricultural land area within the boundaries of a single municipal unit.

This Regional Law establishes the modalities of valuation of the price of public land plots or plots of land with undelimited ownership for the purpose of sale thereof to the owners of edifices and constructions located thereon. The price of the aforesaid plots of land shall be established at 7, 5 percent of cadastre value of the aforesaid land plots.

These Regulations, made by the Minister of Natural Resources and Environment under sections 67 and 136 of the Mining Act, concern assignment of prospecting licences, prospecting permits for medium-scale mining operations and mining permits over areas as specified in the Regulations (reserved areas). Rights may be assigned by public auction, lottery, and applications by invitation. Areas of land that were not allocated shall revert to being vacant state land.

Article 19.2 shall be amended to add the following wording: “Plots of land separated out of unrequested land shares and owned by subjects of the Russian Federation from the date before 1 July 2011, shall be allotted in accordance with the modalities and on terms envisaged by item 5.1 of the Article 10 of this Federal Law”.

Article 2.1 shall be amended to add the following wording: “Minimum and maximum dimensions of land plots as established by this Regional Law, shall be applicable to the purpose of allotment of land plots, pertaining to state and municipal property, until validation by the Urban Code of the Russian Federation of land tenure and land-use planning rules on the territory of municipal units”.

Article 5 shall be amended to add the following wording: “Regional Legislative Assembly shall have competence in lawmaking in the sphere of land relations, law enforcement in the aforesaid sphere, establishment of case of transfer to citizens public and municipal land plots free of charge in specific cases, registration of citizens pertaining to the categories that have the right to allotment of land plots free of charge, and regulation of other land relations that are not exclusive competence of the Russian Federation”.

Article 5 shall be amended to add the following wording: “Plots of land out of stock of public or municipal land shall be conceded on lease and tenancy free of charge for farming within the following limits: maximum agricultural land area 50 ha, and minimum agricultural land area 2 ha”.

Regional administration establishes the following dimensions of public and municipal agricultural land plots that can be allotted to peasant farms for family farming: (a) maximum agricultural land area 100, 0 ha; and (b) minimum agricultural land area – 1, 0 ha.
