These Regulations implement provisions of the Sectional Titles Act in relation with a wide variety of matters including: preparation of draft section plans, submission of a draft sectional plan to Surveyor‐General; certificates of title, sectional title registers, registration and certification of transfers and subdivisions and sectional mortgage bonds.

This Act makes provision for the registration of title in land and defines effects of registration of title. The Act also provides other rules relative to dealings in land. Land in respect of which title has been registered under this Act may not be transferred, mortgaged, leased or otherwise dealt with, and an instrument that purports to deal with such land shall not be registered, except in accordance with this Act. Rights in land shall be registered with the Registrar of Titles of Norfolk Island.

This Act makes provision for the subdivision of land under Part 5 of the Planning Act 2002 and related matters such as the making of subdivision plans and the registration of subdivisions. The Act sets out requirements for a subdivision development application in addition to the requirements set out in Division 1 of Part 5 of the Planning Act 2002. The Registrar of Titles shall not register a subdivision or amalgamation of land without a written notice from the Chief Executive Officer stating approval and fulfilment of other conditions. The Act also provides for review of decisions.

Law on land use planning and building law (Building Law).

The present Law implements the Federal Land Use Planning Law of 22 June 1979 and is the basis for measures concerning land use planning and building of the Canton and municipalities. The Law aims to: a) a purposeful, especially thrifty use of land; b) the promotion of a meaningful and orderly development of the settlement; c) the protection of cultural heritage, landscapes and natural resources from impairment.

The present Law introduces some amendments to the Law on land use planning and building (Building Law) of 12 May 2003. In particular, the Law amends article 80 establishing that the Executive Council and the federal government agree on a joint programme in the areas of nature conservation and cultural heritage. If the costs on behalf of the Canton exceed more than 1.8 millions francs the approval of the Cantonal Executive Council is required.

L’article 1er établit que lorsque la réalisation d’un plan de zones ou d’un plan spécial l’exige, il convient de procéder au remembrement de terrains à bâtir. Ordonnance sur les constructions et l’aménagement du territoire.

La présente ordonnance met en exécution la loi du 25 juin 1987 sur les constructions et l'aménagement du territoire. L’article 2 établit que par voie de règlement, les communes ont la faculté d'édicter des dispositions complémentaires ou dérogatoires dans la mesure où la présente ordonnance l'admet expressément.
