Regional Law No. 14-RZ “On turnover of agricultural land”.

This Regional Law regulates the issues of agricultural land. It establishes that minimum consolidated land area of agricultural land shall be 0, 1 ha and maximum agricultural land area located within the boundaries of a single municipal unit that can be owned by a single natural or legal person shall not exceed 10 percent of total available agricultural land area. Minimum period of lease of plots of agricultural land shall be set forth as follows: (a) for haymaking and grazing – 3 months; (b) for growing of annual plants – 9 months; and (c) for growing of perennial plants – 3 years.

La presente Ley tienen como propósito incrementar el acceso al crédito, ampliando las categorías de bienes que pueden ser dados en garantía y el alcance de los derechos sobre estos, creando un régimen unitario y simplificado para la constitución, publicidad, prelación y ejecución de garantías mobiliarias, y del Sistema de Garantías Mobiliarias que por ella se crea.

Article 5 shall be amended to add the following wording: “5. Allotment of plots of land to citizens with three or more children, registered in the list of citizens having the right to allotment of plot of land and that have not been allotted plot of land shall be performed by local government authority”.

The list of categories of activities subject to determination of land price and lease estimates shall include parking, motor transport servicing, gas-filling stations, trading places, public catering, hotels, camping, tourist resorts and land-use planning.

This Regional Law establishes that plots of public land can be allotted to natural and legal persons in ownership or in lease, in case of availability of free land areas, for use for specific purposes in accordance with purposeful classification of land. Transfer of land ownership right or transfer in lease of public land plots shall be legalized in the form of decision issued by the Regional Government. Public or municipal agricultural land can be allotted on lease to citizens on condition of short-term lease (up to three years) without the right of buyout for grazing and haymaking.

This Regional Law regulates relations concerning allotment free of charge of plots of public or municipal land for individual housing construction to citizens with two or more children, and also to young families. The aforesaid plots of land shall be initially allotted on lease for the period of five years with subsequent transfer of the plot of land in ownership in case of state registration of ownership to constructed edifice within the aforesaid period.

This Regional Law establishes the modalities of determination of the price of land pertaining to regional land property and the price of public land with undelimited property in case of sale thereof to the owners of constructions and edifices located thereupon and also the modalities of determination of rent for lease of land plots, including the modalities, terms and conditions of payment of rent. The price of land in case of sale shall be linked to cadastre value of land plots.

Decree No. 608 of the Council of Ministers validating the Regulation on the modalities of conduct of electronic auctions for sale of public plots of land and the right of the conclusion of lease contracts related to public land plots.

This Decree establishes the modalities of organization and conduct of electronic auctions for sale of public plots of land and the right of the conclusion of lease contracts related to public land plots destined for sale for residential housing construction and lease contracts for servicing thereof. Seller of public land plots shall be state legal person and seller of the right of lease of public land plots shall be lease provider. Organizer of electronic auctions shall supply clients with all the necessary information related to auction sales.

This Law establishes that object of lease of land shall be land plots pertaining to ownership of natural and legal persons, municipal and public ownership. Leaseholders of land plots can be the following categories: (a) regional, provincial and city administration within plenary powers envisaged by acting legislation; (b) public administration of rural areas; and (c) natural and legal persons of Ukraine, foreigners and stateless persons, foreign legal persons and international associations and organizations, and foreign states.

Article 88 of Water Code shall be amended to add the following wording: “Land of coastal (littoral) water conservation zones pertaining to public and municipal property can be transferred on lease exclusively for purposes established by this Water Code”. Article 60 of Land Code shall be amended to add the following wording: “Along marine shoreline and near sea gulfs shall be established protection land belt no less than two kilometres wide from waterline”.
