Land Tenants (Security of Tenure) (Forms and Notices) Regulations (Cap. 59:54).

These Regulations prescribe forms for purposes of the Land Tenants (Security of Tenure) Act and provide that a landlord or a tenant may require a written memorandum of statutory lease in case of continuance of such lease. A memorandum of lease shall be in the form as prescribed in the Schedule to these Regulations and non-fulfilment of the requirements shall constitute an offence. Forms in the Schedule include also: a tenant's or landlord's notice and notification under section 9 of the Act; a tenant's notice under section 4 of the Act.

This Notification, made under the State Land (Regularisation of Tenure) Act, prescribes the form of a delegation to support the application for a certificate of comfort as provided for by regulation 2 of the State Land (Regularisation of Tenure) (Certificate of Comfort) Regulations, 2000. Those Regulations implement section 11 of the Act which provides for the granting of a certificate of comfort against ejectment. Such certificate does not constitute a title in land.

These Regulations provides for the application for and granting of a certificate of comfort against ejectment pursuant to section 11 of the State Land (Regularisation of Tenure) Act, 1998. In accordance with these Regulations, a squatter shall apply for a certificate in a prescribed form and attach to the application document of proof of occupation of the dwelling. Regulation 4 provides for application in case the application is out of occupation.

This Circular amends and supplements various points of Finance Ministry’s Circular No. 120/2005/TT-BTC guiding the Government’s Decree No. 142/2005/ND-CP on collection of land rents and water surface rents.Amendments have been made to: Section I of Part B on land rent rates for annual rent payment; Section III of Part B on the percentage for calculating the land rent rate with annual rent payment; and to Item 1.4, Point 1, Section IV of Part C on investment licences and business registration certificates.

Item 6 of the Article 97 of Land Code shall be amended to add the following wording: “6. Agricultural land shall be allotted: 1) on condition of ownership to the citizens of the Republic of Kazakhstan for subsidiary smallholding, gardening and country housing; 2) on condition of private ownership to or in lease to natural and legal persons of the Republic of Kazakhstan for farming, agricultural production, forest growing, scientific research, experimental and educational purposes, subsidiary smallholding, vegetable gardening and stockbreeding purposes.” Article 2 of the Law No.

The present Regulation provides for the enactment of the Public Land Act. The Regulation focuses on three key themes: land management, compliance and enforcement, appeals and dispute resolution. The Regulation applies to provincial land managed by Sustainable Resource Development under the Public Lands Act. The new rules around recreation apply to vacant public land not held under a disposition that offers exclusive use. The Regulation does not apply to parks/wilderness areas (managed by Tourism, Parks and Recreation) or lands managed by Transportation or Infrastructure.

These Rules concern forms and some other matters prescribed under the Registered Land Ordinance. The forms of the Register and Land Certificate shall be such forms as the Registrar (with the consent of the Governor) may from time to time approve. The forms required to be used under the Ordinance shall be as prescribed in the First Schedule to these Rules.

This Law shall be applicable, inter alia, to state registration of the plots of land, plots of subsoil and forests (Art. 3).
