Land Use Decree (No. 36 of 2010).

This Decree provides for use of native land as defined in the Native Lands Act and Crown land as defined in the Crown lands Act. Utilization of land to which this Decree applies shall be decided by the Prime Minister and all such land shall be registered in the Land Use Bank created under this Decree. The Decree also establishes a Land Use Unit in the Ministry of Lands and Mineral Resources. This office shall be responsible for valuation of land, issue and renewal of leases and collection of rental. Leases issued under this Decree shall be for 99 years and are protected leases.

Royal Decree No. 24.9/20.10.1958 on the codification of established provisions as regards the income of local self-governments.

The present Decree codifies into one unified text the provisions of Royal Decree No. 19.12.1955/21.1.1956 and Legislative Decrees Nos. 3570/1956 and 3777/1957 regarding the income of local self-governments. Among other provisions, the Decree provides for the management of immovable property of local self-governments and establishes rules on licensing, leasing, rights of use and management of communal or municipal slaughterhouses (arts. 3-4), grasslands and pasture lands (arts. 5-11) and medicinal waters (art. 12).

Act to eliminate fees for the maintenance of small parcels of public land (P.L. No. 17-48).

This Act stipulates that the Department of Public Lands shall not assess rental fees in respect to small parcels of public land, not in excess of 300 square meters, adjacent to land used for residential purposes where the residential land owner maintains the public land by removing undesirable vegetation and habitat for pests.

Conservation and Land Management Act 1984 (Act No. 126).

This Act, consisting of 156 sections divided into twelve Parts and completed by one Schedule, establishes a comprehensive set of legislative provisions dealing with state conservation and land management matters. It establishes a number of statutory bodies including the Conservation Commission of Western Australia, the Marine Parks and Reserves Authority, and the Marine Parks and Reserves Scientific Advisory Committee, and it defines their composition, and functions and powers.

Act for the carrying into effect of Titel 7.5 (Lease) of the Civil Code concerning the composition and work procedures of the Land Tribunals and the Central Land Tribunal (Executive Act Land Tribunals).

This Act carries into effect provisions of Title 7.5 of the Civil Code (on land lease), which incorporates provisions of the land Lease Act which has been repealed at the coming into force of the Title. The provisions here implemented concerning Land Tribunals to be designated by the Crown. There shall also be a Central Land Tribunal. The Land Tribunal shall have jurisdiction in applications for the approval of (modification or ending) land lease agreements.

The Act concerns the control of rent for purposes of protection of tenants. It applies to: (a) dwelling houses; (b) all building land (c) public or commercial buildings. Agricultural land seems to be excluded from the application of the Act. The landlord and the tenant shall be deemed to have inserted in every tenancy agreement or lease the covenants set out in the First Schedule and shall be bound by those covenants.

Flexible Tenancies (Review Procedures) Regulations 2012 (S.I. No. 695 of 2012).

These Regulations make provision with respect to the procedure to be followed in conducting a review of a flexible tenancy. Such tenancy may be offered by the landlord to a prospective tenant. They also provide with respect to reviews upon application of a tenant following a decisions of the landlord not to grant another tenancy on the coming to an end of a flexible tenancy.

Land Registration Act, 2012 (Cap. 300).

The Act principally concerns the registration of interests in land. This Act shall apply to: (a) registration of interests in all public land as declared by Article 62 of the Constitution; (b) registration of interests in all private land as declared by Article 64 of the Constitution; and (c) registration and recording of community interests in land.The National Land Commission in consultation with national and county governments may, by order in the Gazette, constitute an area or areas of land to be a land registration unit and may at any time vary the limits of any such units.

This Act makes provision for a wide variety of matters regarding public and private land and community land (as defined respectively by Articles 62, 63, 64 and 260 of the Constitution), and in particular provides of the sustainable administration and management of land and land-based resources. It also provides for (compulsory) acquisition of land.

This Act establishes periods of limitation and other limitations for bringing actions of the various classes mentioned in the Act. Section 42 extends the applicability of the Act also to arbitration. Actions include various actions in respect of land: actions to recover land by the Crown or any person and rent; action to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; and actions in respect of trust property or the personal estate of deceased persons and actions for an account.
