The present Regulation lays down provisions relating to the water property in the domain of the State. Its particular purpose is to determine the conditions under which the Minister of the environment is authorized to grant the alienation, lease or occupation of the property and to agree on the limits of such property. This Regulation lays down amendments and addenda to Regulation No. 531 of 1998 on non-divided agricultural lands. According to these new provisions, undivided agricultural lands, as identified by the competent municipal commission and certified by the chief of the immovable property registration office, can be rented by the local government to foreign and domestic individuals or legal entities.

This Ministerial Decree shall be applicable to land auctions regarding sale of the plots of public land or the lease right thereto and regarding the plots of non-allotted public land. Kazakhstan nationals and private legal persons shall be authorized to participate in land auctions prior registration while foreign natural and legal persons, and stateless persons shall be authorized to participate in land auctions exclusively if the aforesaid persons have the right to own or to have the right of lease of the plots of land destined for sale in accordance with land legislation.

Section 2 establishes that no person shall graze livestock on Crown land except under the authority of: a) a lease under the Agricultural Crown Land Leases Regulation or b) a permit issued by the director under this Regulation. This Legislative Decree aims at land and environmental planning. The present Decree is composed of 20 articles. Article 1 deals with terms and definitions. Article 2 specifies the scope of this Decree. Article 3 defines requirements and conditions for the division of land. Article 4 decrees that the division of land or amendment of division should be adopted by the Ministry of Housing in accordance with provisions of this Decree and of its Implementing Regulations.
