Registration of Documents Act (Cap. 285).

This Act confers powers upon the President of Kenya to grant title or other rights in Government lands, provides for the appointment of a Commissioner of Lands and such other officers as may be necessary for the administration of this Act and defines procedures and other requirements such as registration in respect to grant of title or other rights in Government land.The Act consists of 149 sections divided into 11 Parts.The President may make grants or dispositions of any estates, interests or rights in or over unalienated Government land in accordance with section 3.

Decree No. 9 of the State Committee of Land Resources, Geodesy and Cartography validating the Regulation on the modalities of elaboration of the projects of farm boundary adjustment of the agricultural enterprises.

The Regulation consists of 7 Sections composed of 120 issues dealing with the following matters: 1) general provisions (sect. 1, issues 1-14); 2) preparatory work (sect. 2, issues 15-29); 3) designing project – projecting (sect. 3, issues 30-103); 4) examination and validation of the project (sect. 4, issues 104-109); 5) projecting on site (sect. 5, issues 110-115); 6) mapping (sect. 6, issues 116-118); 7) technical assistance in the implementation of the project (sect. 7, issues 119-120).

Registered Land Rules (Cap. 300).

These Rules implement selected provisions of the Registered Land Act. They define the form of the register in the First Schedule and the form of a title deed and a certificate of lease in the Second Schedule. Any register, certificate of freehold title or instrument which complies with the form prescribed under the Land Consolidation Act shall be deemed to comply with these Rules. The Rules contain other provisions regarding forms, provide for the verification of instruments, prescribe fees for registration and limit powers of the Registrar to prepare a title or registration instrument.

Registered Land (Registration of Maximum Number of Proprietors) Rules (Cap. 300).

These Rules prescribe that only twenty or any lesser number of persons may be registered as the proprietors of any land, lease or charge where charge to the land restricts its user to any purpose other than agriculture and in the opinion of the registrar, the instrument presented for registration will have the effect of vesting the land, lease or charge in such persons jointly as partnership property. The Rules shall only apply to specified registration sections.

Presidential Decree No. 422 on rules regarding expropriation and concession of the plots of land.

The present Decree establishes rules as to expropriation and concession of the plots of land of all categories irrespectively of the kind of land tenure, lifelong hereditary possession, private ownership or lease. The plots of land shall be allotted in conformity with the project of the appropriate allotment thereof. Legal persons, natural persons and citizens interested in the allotment of the plots of land for agricultural commodity production, farming, and subsidiary small-holding, mowing and grazing must submit an application to the local self-government.

Crown Minerals Act (S.S. 1984-85-86, c. C-50.2).

The purpose of the present Act is to ensure the orderly exploitation of minerals in Saskatchewan. The Act contains at the outside a definition clause relating to various terms employed therein, such as “Crown”, “Crown mineral”, “Crown mineral land”, “mine”, “mineral”. This Act applies: a) to all Crown minerals and all Crown mineral lands in Saskatchewan; b) to the granting and acquiring of all rights to and interests in all Crown minerals and all Crown mineral lands; and c) to all Crown dispositions issued under this Act.

Occupiers' Liability Act (Cap. 34).

This Act defines the liability of an occupier of premises for injury to persons or damage caused to goods and resulting from actions or omissions of the occupier in respect of the occupied property. The Act also defines the liability of a landlord under the obligation of maintenance or repair of the occupied property. Where an occupier of premises is bound by contract to permit third persons to enter or use the premises, the duty of care which is owed to them by the occupier cannot be restricted or excluded by that contract.

Circular No. 120/2005/TT-BTC Guiding the Implementation of the Governments Decree No. 142/2005/ND-CP of 14 November 2005 on Collection of Land Rents and Water Surface Rents.

This Circular guides the collection of land rents and water surface rents applicable to cases of land lease and water surface lease. Land shall be classified according to Appendix 1. Sections II and III of Part A specify the payers of land rents and water surface rents, and the subjects not liable to pay land rents. Part B gives specific provisions on land rent rates, water surface rent brackets, determination of land rent rates for specific projects, etc. as specified in articles 4 to 11 of Decree No. 142/2005/ND-CP.

Land Titles Amendment Act (S.A. 2006, c. 21).

The present Act introduces some amendments to the Land Titles Act (Chapter L-4). In particular, it repeals section 3; as well as section 5 which shall read as follows: “Deputy Registrar. The Deputy Registrar may do and perform all the duties required by this Act to be done or performed by the Registrar.” Furthermore, it adds a chapter after section 43 dealing with proof of identity; and one after section 50 concerning refusal to register.

Loi d'application de la loi fédérale sur le bail à ferme agricole.

La présente loi met en exécution la loi fédérale du 4 octobre 1985 sur le bail à ferme agricole. L’article 1 établit que la loi fédérale s'applique au bail à ferme agricole portant sur: a) les immeubles affectés à l'agriculture; b) les entreprises agricoles; c) les entreprises accessoires non agricoles mais formant une unité économique avec une entreprise agricole; et les immeubles de peu d'étendue Ne sont pas soumis à la loi fédérale: a) les vignes de moins de 15 ares; b) d'autres immeubles agricoles non bâtis de moins de 25 ares.

Act to amend the Crown Lands and Forests Act.

The present Act introduces some amendments to the Crown Lands and Forests Act. In particular, it adds after section 94 a paragraph establishing that additional fees shall be paid by a municipality, corporation, board, commission or any person who makes an application to the Minister to do any of the following shall pay the fee prescribed by the regulation: a) to issue a grant of Crown Lands, b) to make an order, to grant or convey land, c) to lease Crown lands shall pay the fee prescribed by regulation.

Rarotonga Motus (Prohibition of Leases) Act 1981-1982 (No. 21 of 1981-1982)

The Act provides that, notwithstanding anything contained in the Cook Islands Act 1915 or in any other enactment or in any order of any court, no person shall be capable of leasing any land on any of the motus of Rarotonga set out in the Schedule to this Act. Nothing in this Act shall affect any interest acquired in any land prior to the commencement of this Act, provided that any dealing in respect of any lease, whether by transfer, assignment or otherwise, and whether occurring before or after the coming into force of this Act, shall be prohibited.
