Government Lands (Charges for Temporary Occupation Licences) Rules (Cap. 280).

These Rules regulate handling of charges for a temporary occupation licence. An applicant for a temporary occupation licence shall deposit with his or her application the amount of the charge prescribed by these Rules for the licence. If the application is refused, the sum deposited shall be refunded to the applicant but if the applicant withdraws his or her application, or refuses or neglects to execute or accept the licence when called upon to do so, the sum deposited shall be forfeited.

This Act makes provision for the administration of Trust land as defined by section 114 of the Constitution of Kenya, the setting apart of an area of Trust land for use and occupation for specified purposes, the use of Trust land and for other related purposes.

This Law is composed of 4 Chapters divided into 25 articles. Chapter I deals with definitions and terms and defines the steps for the concession and exploitation of State lands. Chapter II provides for the definition of private State lands, concession rights, exploitation rights, ownership transfer and land leasing. Chapter III contains offences and penalties. Chapter IV gives general provisions necessary for the issuance of resolutions and regulations for the implementation of this Law.

Resolution No. 37 of 1990 establishing and regulating the industrial zones outside of cities and villages as well as renting their lands.

This Resolution is composed of 21 articles. Article 1 authorizes the creation of industrial zones outside cities and villages by a resolution issued by the Minister of Agriculture and Municipality Affairs including the site, area and borders which shall enter into force after the approval of the Council of Ministries. According to Decree No. 59 of 1989 and Resolution No. 10 of 1989 the lands destined for the industrial zones are considered Real Estate and can be only rent for the creation of the industrial zones (art. 2).

Landlord and Tenant (Shops, Hotels and Catering Establishments) (Rent Book Form) Regulations (Cap. 301).

These Regulations prescribe the form of rent book required to be kept by the landlord under section 3(3) of the Act. The form of rent book is set out in the Schedule to these Regulations.

These Regulations provide rules for proceedings before the Tribunal established under the Tenant (Shops, Hotels and Catering Establishments) Act and prescribe forms of notices relative to tenancy contracts and proceedings before the Tribunal. The Regulations provide that forms used in proceedings before the Tribunal shall be the forms used in subordinate courts from time to time with such modification as may be necessary.

Distress for Rent Act (Cap. 293).

This Act makes provision with respect to distress for the recovery of any rent or rent service in arrear and due upon a grant, lease, demise or contract. This Act shall apply also to lease of any land used for agricultural or pastoral purposes. One of the remedies available to the creditor is to instruct a licensed auctioneer to seize and secure any stock or crops loose and not attached to the land under lease. Rules for proper distress action are given and wrongful distraint is declared to be an offence and shall be punished in accordance with provisions of this Act.

These Rules implement provisions of the Distress for Rent Act with respect to certificates for a licensed auctioneer to seize and secure any stock or crops loose and not attached to the land under lease for purposes of distress. Certificates may be either general or special. A special certificate shall specify the particular distress or distresses to which it applies.

This Act provides rules for a "controlled tenancy" i.e. a tenancy of a shop, hotel or catering establishment that is not based on a written contract or which is for a period of less than five years or is based on a contract that contains provision for termination, otherwise than for breach of covenant, within five years.The Act proposes a prescribed form of contract for a controlled tenancy and makes terms and conditions set forth in the Schedule to this Act applicable to a controlled tenancy.
