This Law regulates property relations and classifies the types of ownership in three categories: (a) private; (b) collective; and (c) public. It establishes that the objects of property shall be land, subsoil, water resources, vegetable and animal kingdom. Plots of land and vegetation thereon can pertain to private ownership. Land, subsoil, water, forests and other natural resources shall be public property. Foreign land tenure shall be authorized except for agricultural land and forest land.

La presente Ley crea el Sistema nacional de vivienda de interés social, establece el subsidio familiar de vivienda y reforma el Instituto de Crédito Territorial (ICT). Además, se crea el Instituto Nacional de Vivienda de Interés Social y Reforma Urbana (Inurbe), establecimiento público del orden nacional, adscrito al Ministerio de Ambiente, Vivienda y Desarrollo Territorial.

This Ministerial Decree establishes the modalities for organizing and holding auctions for public or municipal land or for the right to conclude contracts of tenancy and lease thereof. Auctions shall be open with respect to participants and may be carried out in the form of tender, while auctions may be closed with respect to the submission and amount of offers. Auctions shall be held as necessary to establish contractual obligations related to land management.

This Act lays down basic provisions on land tenure, both rural and urban. All land in Viet Nam is the property of the State, but individual and corporate users, both domestic and foreign, can obtain from the State usufructuary rights under lease-type contractual arrangements (art. 1). Long-term leases, in particular, of cropland are made for twenty years for annual crops and aquaculture, and for fifty years for perennial crops, both terms being renewable on expiry (art. 20).

This Decree provides for the distribution and sale of state owned land for residential houses and for commercial or multi-storied buildings.According to the Decree, individuals who do not own any house or land may be eligible for land allocation from the state.The Decree regulates how and where different classes of applicants should submit their application for purchase of land for a residential house. The land shall be given to the eligible person within six months from the time the applicant fulfils the formalities, including the payment of the purchase price.
