Law No. 963-IV on state control over land tenure and protection of land.

The present Law establishes legal economic and social bases for the organization of carrying out state control over land tenure and protection of land and is aimed at ensuring rational use and reproduction of natural resources. The Law consists of 14 articles. Article 1 introduces the main concepts. Article 2 establishes the main tasks of state control over land tenure and protection of land. Article 3 establishes the main principles of carrying out state control over land tenure and protection of land. Article 4 regards land as object of state control and protection.

The Act, consisting of 15 Parts completed by 17 Schedules, concerns the management of public land in the territory of Victoria. The Act consists of 416 sections and is divided into the following Parts: Crown Lands Generally; Leases of Agricultural College Lands; Development Leases; Leases and Licences for Electric Lines; General; Vacant and Unclaimed Lands; Bed and Banks of Certain Watercourses; Unused Roads and Water Frontages; Limitation of Jurisdictions for Supreme Court; Regulations and Transitional provisions.

This Act revokes the reservations and Crown grants related to certain lands in Victoria. Under section 9, consequences of the revocation include that the land is that land is deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests and the appointment of any committee of management of that land is revoked to the extent that it relates to that land.

Crown Land (Reserves) Act 1978.

This Act, consisting of seven Parts, provides for the reservation of certain Crown lands and their management. Reserved lands are managed by committees of management whose functions and powers are defined in Part 3. Part 4 contains special provisions on certain reserved lands: land used for horse or greyhound racing, landing grounds, marinas, sport facilities and activities and mineral springs. Part 6 contains provisions relating to particular Crown land reserves.

The present Regional Law determines the utmost (maximum and minimum) limits of the plots of land and the modalities of their delimitation on the regional territory. The Regional Law consists of 14 Articles. Article 1 determines the sphere of application. Article 2 regards legislation on maximum limits of the plots of land. Article 3 establishes the modalities of the determination of the maximum limits of the plots of land. Article 4 establishes maximum limits of the plots of land conceded for farming. Article 5 establishes maximum limits of the plots of land conceded for gardening.

Aboriginal Land (Northcote Land) Act 1989.

This Act aims to auhtorize the granting by the Crown of land at Northcote to the Aborigines Advancement League Incorporated. Section 6 stipulates that no compensation is payable by the Crown in respect of anything done under or arising out of this Act. The Act is completed by one Schedule specifying land which may be granted to the Aborigines Advancement League Incorporated.

Aboriginal Lands Act 1991 (Act No. 38).

The purpose of this Act is to authorize the granting of public land for Aboriginal cultural and burial purposes. The Act provides for the closure of roads in the areas (sect. 4), extinguishes existing rights on the land (sect. 5), prohibits the sale of land (sect. 7) and states that no compensation is payable by the Crown in respect of anything done under or arising out of this Act (sect. 9).

Decree-Law No. 32/87 on State’s withdrawal from the management of production units.

This Decree-Law, composed of 39 articles, rules on State’s withdrawal from the management of production units. To this end, it stipulates that the Government shall implement development programmes, as well as define the guidelines for the zoning of the production units to be assigned. The Decree-Law indicates the procedures for State withdrawal, the applicable concession regime, the forbidden property concessions, and the admitted applicants.

This Dispatch, composed of 2 articles, institutes the Unit for the Coordination and Technical Assistance for the production units’ concession. This Unit, a body of the Ministry for Agriculture and Fisheries, is responsible for the organization and direction and control of all the processes dealing with citizen’s involvement in the management of production units.

In particular, the Decree regulates: the procedures for the production units’ assignment to collective or individual users, the contracts, the procedures for requesting a concession. Finally, it indicates the related managing authorities.

Land Conservation (Vehicle Control) Act 1972.

This Act aims at preventing soil erosion and damages to public land caused by vehicular traffic. Under section 5, the Governor in Council may declare any public land to be an erosion hazard area, and the Act provides for the management of such areas.
