Le présent décret abroge, les dispositions du troisième tiret (la direction générale de la gestion et des ventes) et les dispositions du troisième tiret du premier paragraphe (la direction de la location et de l'affectation) de l'article 27 du décret n° 99-1235 du 31 mai 1999, portant organisation du ministère des domaines de l'Etat et des affaires foncières.Celles-ci sont remplacées respectivement par: «de la location des carrières appartenant au domaine privé de l'Etat»; «de la location des carrières appartenant au domaine privé de l'Etat».

This Regional Law establishes that forest land plots granted to citizens free of charge or with the establishment of servitude for agro-forestry (haymaking, grazing, apiculture, reindeer ranching, growing of crops etc.). Land areas shall be established within the following limits: (a) arable land – 3 ha; (b) haymaking – 10 ha; (c) apiculture – 0, 3 ha; and (d) other agricultural activities – 5 ha. Citizens shall have the right to allotment of several forest land plots for performance of different agricultural activities.

The present Regulations are made under the Crown Minerals Act. For the purpose of the present Regulations a “mineral royalty” is a payment to the owner of mineral rights for the privilege of extracting the mineral from the ground based on a lease agreement. The royalty payment is based on a portion of earnings from production and varies depending on the type of mineral and the market conditions.

The present Regulations are made under Mineral Resources Act, 1985 which was repealed by the Crown Minerals Act (C-50.2), but these Regulations continue in force under the Crown Minerals Act. Section 5 establishes that an application for a permit to explore for helium and associated gases may be submitted to the department, and the Minister may issue such permits in accordance with the present Regulations.

This Regional Law regulates the issues of allotment of public land to some categories of workers (transport, forestry, hunting institutions, and protected areas) that due to their service must constantly live outside urban areas for the period of duration of their employment by organization on condition of land tenancy free of charge for a limited period of time. Allotted land area shall not exceed maximum allowable limit established for allotment of land plots for subsidiary smallholding.

This Regional Law establishes cases of expropriation, including bailout, of public land for public or municipal needs. The aforesaid expropriation shall be authorized in the following cases: (a) reservation of land plots for subsequent expropriation (bailout) of land plots for regional and municipal needs; (b) construction of public edifices in case of impossibility to locate them differently; and (c) construction in accordance with land-use planning scheme.

This Regional Law establishes the modalities of calculation of the price of land pertaining to public or municipal property in case of land sale to the owners of edifices, constructions and buildings located thereon. The price shall be calculated as tenfold rate of land tax for the current calendar year per land area unit.

This Regional Law establishes the modalities of transfer of land from one category to another, the modalities of land tenure, rational management and monitoring of land, application of public servitude, land expropriation, establishment of protected areas and land classification. Allotment of land free of charge to categories of citizens that have such right shall be performed by decision of the Regional Government.
