Hessen Polluted Sites and Soil Protection Law.

The present Law implements the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). In particular, the Law lays down provisions relating to rehabilitation of polluted sites through: 1) prevention of harmful soil changes; 2) protection of soil against erosion and adverse effects on soil structure; 3) a sparing and careful use of land; 4) the remediation of harmful soil changes and contaminated sites and water pollution caused by this.

The present Law implements the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). The purpose of the Law is to ensure and reinstate effectively the conditions and functions of the soil. The text consists of 17 articles divided into 4 Parts as follows: General provisions (1); Information on soil and contaminated sites, territorially-based soil protection (2); Responsibility, compensation, costs (3); Final provisions (4).

High Hedges (Scotland) Act 2013 (2013 asp 6).

This Act grants the right to an owner or occupier of a domestic property who considers that the height of a high hedge situated on land owned or occupied by another person adversely affects the enjoyment of the domestic property to apply to the relevant local authority for a high hedge notice. A relevant local authority must dismiss an application in specified circumstances. Where a relevant local authority decides under section 6(5)(b) that action should be taken, it must issue a high hedge notice as soon as is reasonably practicable after making 15 that decision.

Mountain Catchment Areas Act.

This Act makes provision for the conservation, use, management and control of land situated in mountain catchment areas. "Mountain catchment area" means any area declared by the Minister or competent authorities of provinces under section 2 to be a mountain catchment area.

In particular, the Ordinance lays down provisions relating to the collection of fees charged for official acts on behalf of responsible authorities and offices as listed in the Annex. These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).

Water Associations Law.

The present Law implements the Federal Water Association Act of 12 February 1991 (BGBl. I p. 405). In preparing the budget, the Associations must comply with the principles of efficiency and economy. The budget must include all incomes and expenses anticipated in the relevant financial year. For greater investments over several years, an appropriate plan has to be made. The text consists of 16 articles divided into 4 Parts as follows: Budget, accounting and inspections (1); Public announcements of the competent authority (2); Water charges (3); Dissolution of existing associations (4).

Contaminated Sites Rehabilitation Association Law.

The present Law implements the Federal Soil Protection Act of 17 March 1998 (BGBl I p. 502). In particular, the Law establishes the Contaminated Sites Rehabilitation Association. The tasks of the association are the: 1) remediation of contaminated areas, or of harmful soil changes under the Federal Soil Protection Act; 2) reactivation of contaminated sites; 3) development and testing of new technologies and innovative processes for remediation of contaminated sites and harmful changes to the soil, promotion of water conservation zones.
