Conveyancing Decree, 1973 (N.R.C.D. 175).

This Decree makes provision with respect to the transfer of interests in land. It provides rules relative form and procedure of such transfer and defines the effects of conveyance. The Decree concerns also the recording of oral grant of interest in land under customary law and sets out the content of implied covenants for the transfer of various interests in land, including leasehold.

This Act concerns the validity of claims of prescription which may be lawfully made at common law or by custom to any way or other easement or to any watercourse or to the use of any water, to be enjoyed or derived upon, over or from any land or water. The Act, among other things, sets out criteria for the establishment of the period after which a claim shall be held valid.

Land Consolidation Act.

The present Act lays down provisions relating to land consolidation. Article 1 establishes that to improve production, working conditions in agriculture and forestry, as well as to improve general land use planning and land development, owned land may be consolidated. This is executed by means of official procedures within a certain area with the participation of the totality of land owners and competent authorities. The implementation of land consolidation shall be given top priority by the Länder. Accordingly, they shall appoint the competent organs.

Basic Land Consolidation Act 1951 on the treatment of forest and pasture servitude, as well as other special servitudes.

Décret portant application de la loi n° 2006 - 031 fixant le régime juridique de la propriété foncière privée non titrée.

Le présent décret fixe les modalités d’application de la loi n°2006-031 du 24 novembre 2006 sur la propriété foncière privée non titrée, notamment les modalités de mise en œuvre de la création du certificat foncier, la reconnaissance locale, les conditions de recevabilité et de résolution des oppositions éventuelles. Il détermine aussi les modalités réglant la gestion de ce certificat foncier, ainsi que la procédure à suivre pour sa transformation en titre foncier.

Customary Law Act (Chapter 16:01).

This Act concerns the ascertainment and application of customary law in Botswana."Customary law" means, in relation to any particular tribe or tribal community, the customary law of that tribe or community so far as it is not incompatible with the provisions of any written law or contrary to morality, humanity or natural justice.

Tribal Land (Land Board Service) Regulations (Chapter 32:02).

These Regulations, made under the Tribal Land Act, concern the administration of tribal land and related matters.The Regulations provide for the constitution and abolition of Land Board Offices by the Director appointed under the Act and for the establishment of Land boards consultative committees in each land board. They also establish the Land Board (Joint Staff Consultative) Council and provide for other matters relating to the administration of land boards.
