The Ministry of Food, Agriculture and Fisheries may grant subsidies to owners and tenants of farms for the maintainance of changed drainage in areas specifically designated, and which have been subject to a commitment of funding to the regulation of drainage conditions, as provided in article 10. This Order is regulated by the Danish AgriFish Agency by delegation of the Ministry and designates areas subject to application for financial support and for agreements beginning 1 September 2007 or 1 September 2008. For calendar years after 2008 the Agency shall determine the designation of areas of application for the commitment of funding under this Order. Areas designated within the very sensitive agricultural areas (SFL areas) designated under one of the Ministry's regulations on subsidies for agri-environmental measures shall enter into force on 31 December 2006. The commitment period begins on 1 September and ends on 31 August five years later. Approval of a subsidy for an area is subject to: the agreeing parties shall operate the said areas (1); that the area is not included in the commitment period covered by a subsidy scheme for forestry (2); the area is not within the period of commitment imposed on forest reserve duty, except for non-vegetated forest reserve areas (3); the area is not effective within the commitment period covered by the agreement or easement under the EU-Directive on the criteria for awarding funds to restore wetlands or EU-Directive on wetland restoration (4); and that the commitment holders each year of the commitment period declare that the conditions of the undertaking are fulfilled, see article 23 , and the statement is received by the Danish AgriFish Agency latest 1 August (5).
