This Act provides for a transition mechanism in order to achieve devolving of government functions in Kenya. For this purpose it establishes a Transition Authority. The objectives of the Act include: (a) to provide a legal and institutional framework for a coordinated transition to the devolved system of government while ensuring continued delivery of services to citizens; (b) to provide, pursuant to section 15 of the Sixth Schedule to the Constitution, for the transfer of powers and functions to the national and county governments; (c) to provide mechanisms to ensure that the Commission for the Implementation of the Constitution performs its role in monitoring and overseeing the effective implementation of the devolved system of government effectively. The Act also provides for the transfer of assets, including land, within the administration.
