Forest Tenure

This Ministerial Decree establishes the modalities of land valuation with a view of establishment of the cost of forest land for the purpose of compensation of damages in case of use of plots of forest land for purpose not related to forestry and, in particular due to land expropriation, provisional land occupation or restriction of land ownership rights of forest land plots.

These Regulations amend the Planning and Development Regulations 2001 in provisions concerning exempted development.

This Regulation sets out the rules and procedures of the management and administration of natural protected areas and natural heritage sites falling under the authority of the state. The Regulation also covers rules and procedures of appropriation of such areas as well as managing the rules of selling, exchange and renting.

These Rules, which apply in relation to England and Wales, set out the written representations procedure or oral hearing procedure to be followed in respect of an application for a necessary wayleave or a reference for an order for the felling or lopping of trees or shrubs.

These Regulations concern forest land management and related taxation. They describe the procedure for the assessment of taxes, exemptions, reporting requirements, planning and refunds of overpayment and provide for the “certificate of managed land” (sect. 17).

The asset register of state-owned agricultural, forestry and other lands must be kept by the National Land Fund Managing Organization. This Decree determines the kind of information to be included in the register, such as data regarding the location of the property or information regarding rights and obligations on a property.

This Order establishes that protection area shall be established with a view of protection of unique nature complexes and ecosystems of the protected area against unfavourable anthropogenic impact, conservation of old-age forests and biological diversity. Forest plots within the boundaries of protection area shall not be expropriated from landowners, land tenants, and servitude holders.
