Cette loi modifie les articles 16 et 27 de la loi nº 95-21 portant régime relatif aux immeubles domaniaux agricoles. On entend par immeubles domaniaux agricoles les terres dont l'Etat est propriétaire et qui sont destinées à la production agricole, celles pouvant servir de support à cette production ou celles qui ont été classées comme telles, ainsi que les bâtiments qui s'y trouvent.

Crown Lands Regulations.

These Regulations implement the Crown Lands Act by further making provision for leases of crown lands and licences for activities to be carried on such lands. Provisions of Part 2 define which lands are available for leases, regulate commencement, execution, and surrender of leases and payment for improvements on land. Various provisions of Part 3 are concerned with licences for grazing of livestock, occupation licences and licences for miscellaneous nature. "Occupation licence" means a licence under section 90 of the Act.

These Regulations, consisting of 11 sections completed by one Schedule, prescribe forms for purposes of Real Property Act. Furthermore provision is made for the sale of real property pursuant to a statutory charge and the attestation of execution of instruments by individuals. The Schedule contains a table of forms including forms relative to variation of priority, grant of easement, transfer of land, grant of right of way, lease, sub-lease, caveat compulsory acquisition, application to amend survey, sale pursuant statutory charge.

Crown Lands Act.

This Act, consisting of 108 sections divided into nine Parts and completed by one Schedule, makes provision for the tenure, management, and alienation of crown lands. "Crown lands" means all lands of the Territory, including the bed of the sea within the territorial limits of the Northern Territory, and including an estate in fee simple that is registered in the name of the Territory, but does not include reserved or dedicated lands. The main body of the Act (Part 3) contains provisions relative to leases, easements, and servitude.

L'article 1er de cette loi fondamentale sur le remembrement des biens ruraux établit qu'afin d'assurer, dans l'intérêt général, une exploitation plus économique des biens ruraux, il peut être procédé, conformément aux dispositions de la présente loi, au remembrement des terres morcelées et des terres dispersées. Le remembrement tend à améliorer les biens-fonds en constituant, par un nouveau lotissement, des parcelles ayant de plus grandes surfaces, des formes mieux adaptées aux façons culturales et des accès indépendants.

Law on the lease of agricultural land.

Provisions of this Act apply also to forests and certain inland waters exploited for agricultural purposes, certain buildings and other objects listed in article 2. Agricultural lands are arable lands, natural meadowlands and pastures. The basis of lease is an agreement between lessor and lessee. This Agreement defines issues specified in article 4, such as terms of returning lease object at the expiration of a term of lease; terms for exploitation and cure of leased objects.

In order to remove the violations in calculation and payment of the rents, in regulation of the use of the land plots of the Agricultural Lands Redistribution Reserve under the Ministry of agriculture and water economy of the Kyrgyz Republic the Government of the Kyrgyz Republic hereby decrees that seed production and cattle breeding farms, dairy farms having not less than 10 milk cows using the lands of Agricultural Lands Redistribution Reserve under the Ministry of agriculture and water economy of the Kyrgyz Republic shall be free from rent and shall pay only the land tax.

" Lease is timely compensable contract based possession and use of land, other natural resources, enterprises (associations) and other property complexes and other property necessary to a lessee for independent performance of economic and other activity". Lease is allowed in all branches of economy and may apply to property of all types and forms of ownership (art. 3).

Lessees who have entered into lease relationships before the effectuation of this Law shall be entitled to conduct their economic activity in compliance with lease contracts entered into before December 31 of 1989, and those who entered into lease relationships from January 1, 1990 shall conduct their activity in compliance with Legislation Fundamentals of the Soviet Union and Union Republics on Lease. Various tasks are assigned to the executive forces in relation with the implementation of provisions of the Law on lease.

These Regulations regulate the lease of crown lands to residents. Applications for renting crown lands shall be made to the Chief Surveyor and shall be forwarded to the Minister. Control shall be carried out that no proposed area shall be part of a forest reserve. An agreement shall be signed between the Chief Surveyor on behalf of the Government and the applicant in the form as set out in the Schedule. The agreement shall contain conditions as the Governor-general may deem fit.
