The purpose of this Law is to regulate relations arising from the matters of powers of the legislative and executive organs concerning ownership rights on state and local property, level of authority of a legal person with state property and its administration, principle and regulations of activity of an organ implementing policy on state property.

Plots of land on which privatized state enterprises and objects are situated imply land conceded in use within the rights specified in technical certificate at the moment of privatization of state enterprises and objects. Tenants are legal and natural persons whose property rights to state enterprises and objects are confirmed by the respective contract of sale and by certificate issued by the State property committee.

This Law, composed of 17 articles, regulates the use, conservation and protection measures for agricultural land, considered as a common heritage. The Law defines agricultural land characteristics and planning requirements to be applied to both private and public agricultural properties. Moreover, it compels São Paulo’s Secretary of Agriculture to plan and implement the provisions set that shall turn compulsory within the following five years. Finally, the Law establishes the penalties for non compliance with its provisions.

Land in the Republic of Tajikistan is exclusive state property, and the state guarantees its efficient use in the interests of the population. One of the main ways of the agricultural development of the country is the improvement of the state of ameliorated land, organization of complete, rational and efficient use of available land and development of new lands. The Regulation consists of 18 Sections. Section 1 is a foreword. Section 2 regards land resources. Section 3 regards arable land. Section 4 regards perennial plants’ land. Section 5 regards hay-making and grazing land.

The present Regulation establishes the modalities of the institution and examination of the applications of enterprises, institutions and organizations, and also of citizens regarding concession of the plots of land out of all categories of land irrespectively of the type of ownership except for cases envisaged by the legislation. Concession of land shall be carried out in the form of allotment in accordance with decree of the Government or of the respective organ of executive power. The document consists of 6 sections. Section 1 lays down general provisions.

El presente Decreto introduce reformas a la Ley del Régimen especial de la tierra en propiedad de las asociaciones cooperativas, comunales y comunitarias campesinas, disponiendo que los inmuebles que contengan bosques o tierras de vocación forestal, técnicamente calificados como tales, se transfieren al Estado como áreas naturales protegidas.

This Decree, composed of 30 articles, implements the Law No. 6.171 on the use, conservation and protection of agricultural land, envisaged as common heritage. The use and management of agricultural land shall be carried out through land use planning in accordance with the current land conservation agricultural techniques. The Decree defines the functions and powers of the Secreatry for Agriculture, the competent authority for the implementation of the provisions set under this Decree.

This Act makes rules for the sale of public land that has been rendered habitable or arable through Government waterworks. The purpose of the sale is to populate these areas. A Commission shall be formed to carry out land measurements, to prepare the plans of land to be sold and to establish prices. Lands shall be divided into three categories according to their potential use and be priced accordingly. No private lands shall be included into the charts of sale and “the rights of original owners will not be impaired”.

This Decree consists of 5 Sections that contain 28 articles. Section 1 (arts. 1-4) lays down general provisions. Section 2 (arts. 5-11) specifies the objects of privatization. Section 3 (arts. 12-16) classifies the types of privatization. Section 4 (arts. 17-26) establishes the modalities and terms of privatization. Section 5 (arts. 27 and 28) lays down final and transitional provisions.

Land Code defines the basic directions of State regulatory system improvement concerning land relations, development of various organizational and legal forms of land economy, fertility of land, improvement of land use efficiency, protection and improvement of the environment – favourable for human life and health, and the legal framework concerning the protection of the land rights. Ownership, use and disposition of land must not damage the environment, security and defensibility of the State; must not violate rights and legally defined interests of citizens and other entities.
