The President, for the purpose of increasing production of agricultural commodities, decrees that the Committee on land resources attached to the Government together with Hukumats of the regions, towns and districts should allocate to citizens till February 1, 1998, 25 thousand hectares of irrigated and dry arable lands for personal farms (without the right to build houses and other establishments of household and domestic purpose, planting and cutting of fruit and forestry plants) according to the established order.

The Government notes that as a result of realization of the Presidential Decree No. 874 of 1997 on allocation of 25 thousand hectares of lands for personal subsidiary farm of the citizens for increasing production of agricultural commodities there has been achieved real increase in production of grain, potatoes, rice and other agricultural commodities, improved food delivery to the population and the prices for the above-mentioned agricultural commodities have been kept under control. At the same time some mistakes have been committed as regards distribution of land plots.

This Act concerns law applicable to and rights in public lands, i.e. lands situated within the Republic which were owned or maintained by the Japanese government during the Japanese administration of the islands and such other lands as the government of the Republic has acquired or shall acquire for public purposes. Certain rights regarding the marine areas below the ordinary high watermark existing prior to introduction of the law by the Japanese Government shall be re-established.

The Act provides for land allotment to evacuees, land to be used for agricultural production, pasture, house-building: it entitles the evacuee to the right of using the allotted land and, in those cases when allotments were not conceded prior to the issuing of the present Act, it provides for granting them in those cases when claims are compliant with the law.

Section 149 of the principal Act defines the jurisdiction of the Land Court. The jurisdiction of the Court is enlarged by adding a subsection (e) to section 149: The Court may now hear and determine any question or amount of damages, loss, compensation, mesne profit, rent or claim in respect of any allotment, lease, sublease. permit or interests of any kind in any land. Section 152 of the principal Act concerns Orders of Court regarding court proceedings.

Chapter one of this Law contains definitions of terms therein employed, such as: forest, forest bushes, desert shrubs, forest cover and regions, range, planted rangeland, logs and saplings. Chapter two sets out rules for exploitation and protection of the above mentioned areas. Forestry Organization, established within the Ministry of Agriculture, shall supervise and issue permits for each applicant regarding exploitation of these areas. Licence shall be valid up to one year.

The amendments concern the need for authorization from the Ministry of Natural Resources and Agriculture for the conversion of forest and valley land into the following: 1. making farmland, orchard, rangeland, artificial forests, forage land, livestock institutions, aquatic breeding institutions, as well as the use for mine exploting and exploration (in nothern Iran); and 2. establishment of factories, townships, schools, training institutions, sport clubs, etc.
