Registered Land Rules (Cap. 300).

These Rules implement selected provisions of the Registered Land Act. They define the form of the register in the First Schedule and the form of a title deed and a certificate of lease in the Second Schedule. Any register, certificate of freehold title or instrument which complies with the form prescribed under the Land Consolidation Act shall be deemed to comply with these Rules. The Rules contain other provisions regarding forms, provide for the verification of instruments, prescribe fees for registration and limit powers of the Registrar to prepare a title or registration instrument.

Registered Land (Registration of Maximum Number of Proprietors) Rules (Cap. 300).

These Rules prescribe that only twenty or any lesser number of persons may be registered as the proprietors of any land, lease or charge where charge to the land restricts its user to any purpose other than agriculture and in the opinion of the registrar, the instrument presented for registration will have the effect of vesting the land, lease or charge in such persons jointly as partnership property. The Rules shall only apply to specified registration sections.

Le présent arrêté modifie certains articles de l’arrêté du 26 mai 2000 susvisé. Entre autres, le texte remplace l’article 2 établissant que le Ministre peut imposer à certains preneurs l'obligation de mentionner sur le document d'écoulement d'engrais le numéro de parcelle sur lesquelles les engrais seront épandus.

Decree No. 6 on subdivision of plots of land.

The present Decree establishes the rules governing land consolidations owned by citizens and legal persons irrespective of the nature of tenure and the presence or absence of constructions thereon. The plots of land registered in the state land cadastre can be subject to consolidation or splitting up. The adjoining plots of land not exceeding the established maximum size ceiling, owned by citizens, can be consolidated.

The present Act ensures the survey of land and the approval of plans. The Act contains at the outset a definition clause relating to various terms employed therein such as, for example, “application for boundary confirmation”, “cadastral parcel mapping system”, “deteriorated monument”, “former land registration district”, “land surveys directory”, “land titles registry”, “lost monument”, “parcel”, “primary survey”, “registered owner”, “re-establishment”, “Registrar of Titles”, etc. Section 4 establishes the Land Surveys Directory.

The purpose of the present Act is to regulate the duties due in land transfer. The Act contains at the outset a definition clause relating to various terms employed therein such as, “consideration”, “corporation not resident in Canada”; “land”, “recreational property”, “transfer”. Section 4 establishes that every transfer made after 11 May 1976 relating to land situated in Quebec requires the transferee to pay duties at the rate of 33 per cent of the value of the consideration.

The purpose of the present act is to ensure the orderly carrying out of professional land surveying. The Act deals with, amongst others, matters such as the continuation of the Association of Nova Scotia Land Surveyors, its powers, acquisition and alienation of property, election zones, holding register for inspection, right of entry on land and liability, offences, etc.

The purpose of the present Act is to: a) provide certainty in ownership of interests in land; b) simplify proof of ownership of interests in land; c) facilitate the economic and efficient execution of transactions affecting interests in land; and d) provide compensation for persons who sustain loss from a failure of the land registration system.
