This Order establishes terms and conditions of registration in the state cadastre of immovable property of the plots of land, construction, edifices and other objects of immovable property subject to state registration, and transfer to the competent cadastre authority of technical certificates related to the objects of immovable property subject to state registration.

Item 5 shall be supplemented with sub-item 4 with the following wording: “4) acts by public authorities or local self-government related to validation of the results of state cadastre valuation of the objects of immovable property (in relation of cadastre value of previously registered objects of immovable property).”.

Les présente instructions du Registre général établissent les modalités de location, de vente ou d’acquisition de l’hypothèque et son inscription chez le Registraire Général.

This Act establishes the Registrar General who shall keep four separate and distinct indexes of: (a) Deeds; (b) probates of Wills and Letters of Administration; (c) judgments, decrees, orders and rules; and (d) memoranda of lis pendens. The Act also provides for examination of documents and certified copies and grants the power to make Rules to the Registrar General.

This Act makes provision for the registration and execution of deeds. It also provides for the protection of purchasers and mortgagees. For the purposes of this Act a memorandum of a statutory lease executed in accordance with the provisions of the Land Tenants (Security of Tenure) Act, shall be deemed to be a deed registrable under this Act. Deeds shall be certified by a licensed Surveyor within the meaning of the Land Surveyors Ordinance.

Le présent arrêté détermine les modalités d'acquisition des certificats d'enregistrement de la propriété foncière. Tout investisseur qui remplit les conditions exigées par la réglementation en matière d’investissement foncier peut faire la demande d’un certificat d’enregistrement d’une propriété foncière. La demande d’un certificat d’enregistrement d’une propriété foncière est adressée au Conservateur ou au Conservateur Adjoint compétent.

This Act grants power to the President to certify the reissue of a grant of lease of State lands which was destroyed or lost. The President may require the lands in respect of which a certificate is applied for to be surveyed and the certificate shall be registered in the office of the Registrar General.

Il est créé un établissement public à caractère industriel et commercial, doté de la personnalité morale et de l’autonomie financière dénommé agence foncière pour l’aménagement des terrains, placée sous la tutelle du ministère en charge des affaires foncières.

Il est créé un établissement public à caractère scientifique et technique, doté de la personnalité morale et jouissant de l’autonomie financière, dénommé bureau d’études et de contrôle des travaux cadastraux. Le bureau d’études et de contrôle des travaux cadastraux est placé sous la tutelle du ministère en charge des affaires foncières.

Il est créé un établissement public à caractère administratif, doté de la personnalité morale et jouissant de l’autonomie financière, dénommé fonds national du cadastre.

These Regulations, in implementing provisions of the Land Surveyors Act, make further provision for registration and qualification of land surveyors and establish rules for carrying out land surveys. Regulations 3 to 5 specify qualifications, whereas regulation 6 concerns registration. A Code of Ethics is laid down in the Third Schedule. Regulation 25 and following contain rules on the carrying out of surveys and the drawing of up land survey plans.
