Registered Land Ordinance (Cap. 9.01).

This Ordinance concerns the organization of land registration, the registration of interests in land and related matters and (transfer of) rights in land such as lease, charges and easements. There shall be a Land Register and a Register of Lands shall be appointed. The Ordinance sets out effects of registration and provides for the protection of persons dealing in registered land.

These Rules prescribe forms for purposes of the Registered Land Ordinance. They also lay down of the First Schedule the form of a register and in Schedule 2 the form of a Land Certificate. Other forms concern, among other things: transfer of land, transfer of lease, transfer of charge, a lease, a charge, grant of an easement and a notice of intention to appeal.

Perpetuities and Accumulations Act 1989.

This Act modifies the law relating to the avoidance of future interests in property on grounds of remoteness and governing accumulations of income from property. The rule against perpetuities shall not apply to an option to acquire for valuable consideration an interest on the term of a lease if: (a) the option is exercisable only by the lessee or his or her successors in title, and (b) it ceases to be exercisable at or before the expiration of one year following the determination of the lease.

Ministerial Decree No. 1419 validating the Regulation on allocation of the plots of land covered by territorial water for the construction of artificial installations.

This Ministerial Decree establishes the modalities of allocation of the plots of land covered by territorial and inland waters of the Caspian sea of the Republic of Kazakhstan for the construction of artificial installations, including harbour facilities. The aforesaid plots of land shall be conceded on lease for the period of 49 years. Concession and transfer of land shall be carried out by the local self-government by agreement with the respective water basin inspections.

Agricultural Holdings Act 1986 (1986 Cap 5).

This Act provides rules relative to tenancy agreements concerning agricultural holdings, i.e. the aggregate of the land comprised in a contract for an agricultural tenancy. The Act among other things: places a restriction on letting agricultural land for less than from year to year, defines various other terms of contract, also in relation to cultivation of land and disposal of produce, and provides with respect to arbitration in relation with tenancy agreements.

This Ministerial Decree establishes the modalities of determination of value (standard price) of agricultural land used for setting start-up price for sale of land in private ownership, conclusion of mortgage contract and formalization of land based credit, compensation for expropriation of land and setting lease price. Standard price of agricultural land shall not include value of constructions and other objects of immovable property located thereon. The whole agricultural land area shall be subject to determination of standard price.

This Parliamentary Decree establishes terms and conditions for concession on lease of agricultural land pertaining to the stock of agricultural land subject to re-distribution. Concession of the plots of agricultural land shall be carried out through tenders, the winner of which shall conclude lease contract within ten days from the date of conclusion of tender. Lease holder shall be prohibited to manage land plots prior to mapping on the boundaries in-situ and issuance of certificate for temporary land tenure.

This Act makes provision with respect to: all transactions where the effect is to secure an obligation with collateral, including pledge, hire-purchase, conditional sale, company charge, chattel mortgage, assignment, and the like; (b) the sale of accounts and chattel paper; (c) consignments; (d) the lease of goods for a period greater than one year; (e) a security interest in a building or other improvement to real property, and to the rental of a building or other improvement to real property for a period greater than one year; and (f) the interest of a lien holder in collateral.

There shall be maintained in Port Vila a Land Records Office in which shall be kept a register to be known as the Land Leases Register. These Regulations provide for matters of the land Records Office such as Hours of public business of the Office, amendments, corrections, erasures, etc. of register, lodgement for registration, fees, evidence of incorporation, execution of instruments by corporations, attestation of instrument, persons interested in instruments may not attest, deposit of deeds in archives.

This Order establishes the Urban land Leases Selection Committee, which shall, within the Municipality of Port Vila: (a) consider, on behalf of the Minister responsible for lands, all applications for the granting of new leases, transfer of leases and surrender of leases for the creation of new leases, transfer and transfer of shares between lessor and lessee companies; (b) advise the Minister on any matter in relation to the such transactions; and (c) do or perform such other functions or responsibilities as the Minister may from time to time direct or delegate.

This Decree provides for use of native land as defined in the Native Lands Act and Crown land as defined in the Crown lands Act. Utilization of land to which this Decree applies shall be decided by the Prime Minister and all such land shall be registered in the Land Use Bank created under this Decree. The Decree also establishes a Land Use Unit in the Ministry of Lands and Mineral Resources. This office shall be responsible for valuation of land, issue and renewal of leases and collection of rental. Leases issued under this Decree shall be for 99 years and are protected leases.
