This Act strengthens the legal framework concerning title to custom land and concerns management of custom land by customary institutions. It formalizes the recognition of customary institutions termed ‘nakamals’ and ‘custom area land tribunals’ to determine the rules of custom which form the basis of ownership and use of land in Vanuatu. In general the Act aims at holding of custom land by owners as a group. Custom land means land owned or occupied, or land in which an interest is held, by one or more persons in accordance with the rules of custom.

This Act amends the Custom Land Management Act with respect dispute resolution regarding custom land.

This Act contains provisions pertaining to five different Acts: The Ashanti Stool Lands Act, 1958 (No. 28); The Stool Lands Act, 1960 (Act 27); The Administration of Lands Act, 9162 (Act 123); The Concessions Act, 1962 (Act 124); and The Minerals Act, 1962 (Act 126).

El presente Decreto tiene por objeto definir los parámetros y el procedimiento que los Resguardos Indígenas o las asociaciones de resguardos deberán cumplir para acreditar la experiencia y/o buenas prácticas como requisito para la ejecución directa de los recursos de la Asignación Especial del Sistema General de Participaciones.

La Ley consta de 13 artículos, 3 disposiciones complementarias, 4 finales y 2 transitorias. La Ley establece los principios generales necesarios para promover la inversión privada en el desarrollo de las actividades económicas en las tierras del territorio nacional y de las comunidades campesinas y nativas (art. 1º).

The Traditional Rights Court shall consist of a permanent panel composed of a Chief Judge and two other judges, and such other members or panels as may be appointed or constituted from time to time as provided for by Section 4 of this Act. The Commission may, for reasons which, in its opinion, are sufficient, suspend or remove any member of the Court or take such other disciplinary action against him oe her as it may deem necessary.

El presente Decreto aprueba el Reglamento de la Ley que establece el procedimiento especial para la adjudicación gratuita de la propiedad colectiva de tierras tradicionalmente ocupadas por los pueblos y comunidades indígenas que no están dentro de las comarcas.

This Act amends Chapter 75 of Title 21 so as to require the Chamorro Land Trust to identify suitable land for the cultivation of native plants used for medicinal purposes and establish the criteria, application, and operational procedures for the allocation of parcels. An applicant must submit a proposal for usage of the parcelled lot and a list of plants to be cultivated.

This Act provides with respect to local courts. The existing Native Courts and Group Native Appeal Courts are re-designated Local Courts and Group Local Appeal Courts and the term "Local" is substituted for the term "Native" in every designation of any such courts in any existing enactment.

This Act amends the Communal Land Reform Act so as to: insert a definition of 'community based organisation', 'lawful resident' and 'occupational land righ'; to place restrictions on the acquisition by foreigners of customary land right or right to leasehold; the power to grant occupational land in respect of communal land rights by a board; conditions applying to such grant; and recognition of existing rights to occupy communal land as occupational land rights.

This Act amends the Land Titles Registration Act 2008 in respect of exclusion of customary land from the definition of "land" and various consequential amendments, including amendments of provisions on recording of customary land for which a judgement has been passed. The record of customary land is not to be interpreted or construed under this Act as a registration of customary land under this Act. Consequential amendment are also made to the Land and Titles Act, 1981.

El presente Decreto reglamenta parcialmente la Ley Nº 160 de 1994 en lo relacionado con la reestructuración de los resguardos de origen colonial previa clarificación sobre la vigencia legal de los respectivos títulos, con las tierras poseídas por los miembros de la parcialidad a título individual o colectivo y los predios adquiridos o donados a favor de la comunidad por el Instituto Colombiano de la Reforma Agraria (Incora) u otras entidades.
