Aboriginal Land Act 1991.

This Act provides for the claim and grant of land as Aboriginal land. It consists of 26 Parts divided into 309 sections.Section 10 defines what is to be intended as Aboriginal land and Part 3 on Formal expression of interest about land, provides for the procedures to be followed in granting transferable land and Aboriginal land.Part 4 on Grant of transferable land as Aboriginal land, contains dispositions on the claiming of land, while Part 5 on Claims for claimable land, regulates the granting of land as Aboriginal land.

Community Services (Torres Strait) Act 1984.

The Act provides for the management of the territory of Torres Strait and for the support to communities residing in the area; it consists of 85 sections divided into 11 Parts. The chief executive is the officer responsible for the administration of the Act. Part 3 provides for the creation of island councils, which are body corporate responsible for the management of council areas. Their operation, functions and powers are regulated under the Act.

This Act establishes and regulates the Land Court, it consists of 94 sections and is divided into six Parts. The Act also establishes a Land Appeal Court, specifies its jurisdiction and operation. Both courts are the continuance of the courts established under the Land Act 1962 and preserved in existence by the Land Act 1994 (Part 6).

This Act provides for the management of land in Queensland, it consists of 522 sections and is divided into nine Chapters. The objectives of the Act and its application are described in Chapter 1. Chapter 2 covers land allocation, in particular allocation powers (Part 1), reservations in grant titles (Part 2) and native title (Part 3). Chapter 3 covers reserves, deeds of grant in trust and roads. Chapter 4 is dedicated to land holdings: making land available (Part 1), eligibility to hold land (Part 2), leases (Part 3) and permits (Part 4).

Local Government (Aboriginal Lands) Act 1978.

This Act provides for the creation of two local government areas and councils, at Aurukun and at Mornington Island. The Act consists of 8 Parts divided into 43 sections: Preliminary (Part 1); Grant of lease (Part 2); Local government areas and councils (Part 3); Coordinating and advisory committees (Part 4); Provisions concerning the shires and their councils (Part 5); Resumptio of leases (Part 5A); Miscellaneous (Part 6); and Validating and transitional provisions (Part 7).

Torres Strait Islander Land Act 1991.

This Act, consisting of 19 Parts divided into 207 Sections, provides for the grant of land as Torres Strait Islander land. The Act recognizes that the land is of spiritual, social, historical, cultural and economic importance to Torres Strait Islanders, who inhabited the territory that is now Queensland before the settlement of Europeans (Preface). Part 2 contains basic concepts on, among others, Island custom and what is to be considered available land that is it claimable under the Act.

This Act concerns the title of native people, Aboriginal people and Torres Strait Islanders, to land in Queensland. It consists of 146 sections and is divided into five Parts. Part 2 is dedicated to validation and its effects, Part 3 concerns the confirmation of certain rights, in particular the ownership of certain natural resources and certain water and fishing access rights and public access to and enjoyment of beaches and certain other places.

The 29 sections are divided into 5 Parts: Preliminary (I); General (II); Leases and connected matters (III); Acquisition of land for public purposes (IV); Miscellaneous (V).All Provinces’ Lands (not defined) are vested in the District Authorities of the Districts in which such lands are situated. They shall be held and administered for the use and common benefit of the communities concerned (sect. 4).

Community Services (Aborigines) Act 1984.

This Act concerns Aboriginal communities that live in Queensland and provides them support, administrative services and assistance. It consists of 187 sections and is divided into 15 Parts. Part 2 concerns the administration of the Act, Part 3 describes the powers of intervention of the State in matters related to Aboriginal matters. Part 4 provides for the incorporation of Aboriginal councils and regulates their operation. Part 8 is dedicated to the Aboriginal Coordinating Council and Part 9 to the Aboriginal Industries Board.

Community Services (Torres Strait) Regulation 1998.

This regulation implements the Community Services (Torres Strait) Act 1984. It consists of 68 sections and is divided into 12 Parts. Part 2 is dedicated to the Island councils, their composition and their membership, Part 3 to the chairpersons of Island councils and Part 4 to the election of Island councils. Part 5 concerns councils’ meetings, Part 8 regulates Island courts and Part 9 the Island Coordinating Council. The regulation is completed by five schedules that provide further for the operation of the bodies regulated in the text.

Community Services (Aboriginal Council) Accounting Standard 2002.

These standards implement the Community Services (Aborigines) Act 1984. They provide standards for Aboriginal councils that are, by law, requested to develop and implement a system for managing financial information (sect. 3). Part 3 concerns accounting and Part 4 internal control and internal audit. The standards are completed by two schedules: minimum period for keeping financial information and dictionary.
