Le pastoralisme comme mode d'élevage, fondé sur la mobilité des éleveurs et des troupeaux, concourt à la satisfaction des besoins économiques et sociaux des populations ainsi qu’à la préservation des équilibres écologiques par une gestion durable des ressources naturelles. Le droit d’accès aux ressources pastorales est entendu comme la garantie pour le pasteur de la liberté de passage vers la ressource naturelle.

Decree No. 142/2005/ND-CP on collection of land rents and water surface rents.

This Decree provides for the collection of land and water surface rents. The State shall lease land or water surface with an annual collection of rents in the cases specified in article 2. Chapter II gives specific provisions on land and water surface rent units and provides for the determination of land and water surface rents, etc. Provisions on land and water surface rent exemption and reduction are provided for in Chapter III. Chapter IV provides for the collection and payment of land and water surface rents.

These Regulations make provision for the control of activities on public beaches in the sense of the Beach Control Act. The holding of a public gathering on a beach shall be subject to authorization by the Beach Control Authority. Other rules concern swimming and use of boats in the sea adjacent to a public beach, disturbing or damaging of flora and fauna on beaches, pollution, erecting of structures, etc.

State Land (Alienation) Act.

This Act states that the portions of State land specified in the Schedule shall vest in the Fund established under the Ilois Trust Fund Act. “State land” shall have the same meaning as in the State Lands Act.

Government Lands (Registration) Rules (Cap. 280).

These Rules concern the registration of any assignment of a lease issued under the Government Lands Act where the premium reserved by such lease is payable to the Government by instalments. The Registrar shall not register such lease unless and until the head lease thereof is produced duly endorsed by the Commissioner of Lands, as provided for in subsection (4) of section 24 of the Act. The endorsement shall also be registered under the Act.

These Rules prescribe, in the Schedule, the form that shall be used in every application for a lease or licence for special purposes under Part V of the Government Lands Act. A deposit shall accompany every application. This shall be allocated towards the amount due in respect of the area if granted or refunded to the applicant if the application is refused. The deposit shall be forfeited if a false statement is made.

These Rules prohibit the lease or sale of Government land outside the area of any township or station within a given distance from the centre of any public road. Furthermore, no building, fencing or other obstacle shall be erected within a given distance from the centre of any public road outside the area of any township or station.

Government Lands (Consents) (Fees) Rules (Cap. 280).

These Rules prescribe a fee for every consent in respect of a transfer conveyance, assignment, mortgage, charge, sale, lease or sub-lease of a developed plot of Government land as provided for Government Lands (Consents) Rules and for every consent in respect of any other transaction or dealing with land (within or outside a municipality) not otherwise provided for in the Government Lands Act. The fee shall be charged notwithstanding anything contained in the Government Lands (Consents) Rules for any consents applied for and given by the Commissioner of Lands.
