Requisitioning of Land Act 1950 (No. 33 of 1950).

This Act regulates the power of the competent authorities to take possession, with the prior approval of the President, of any land for any of the following purposes: (a) maintenance of supplies or services essential to the life of the community; (b) implementation of schemes regarding the import, storage or distribution of commodities by any Government department, local authority, corporation of cooperative society; (c) use or occupation by the armed forces or any visiting force (sect. 2).

This Regional Act lays down the legislative framework concerning the protection of soil, water resources and coastal territories in Toscana. The Act establishes principles for the adoption of programmes, plans and projects to undertake interventions that have an impact on such resources. A Commission for Soil Protection is established (art. 4). Provisions on monitoring and penalties are laid down too.

This Regional Law establishes plenary powers of the regional Legislative Assembly, Governor, Regional Government and authorized regional state executive body in the sphere of land relations. It also establishes maximum agricultural land area (150 ha) and minimum agricultural land area (0, 5 ha) of public and municipal land that can be allotted in ownership for farming. The aforesaid plots of land can be allotted once-only.

The price of land within and outside settlements of the Kaluga Region in the process of selling the plots of land pertaining to state and municipal property to the owners of edifices, constructions and works situated on them is fixed tenfold of land charges for a unit of area of a plot of land. In the process of selling a plot of land there must be applied correction factor to the price of the plot of land taking into account main use of edifices, constructions and works situated on it in accordance with the legislation currently in force.

This Decree establishes the modalities of allotment of land plots of area up to 1, 0 ha on conditions of permanent (open-ended) land tenure through tenders for performance of entrepreneurial activities. It shall be applicable to industrial land areas and non-agricultural land. It contains information related to the modalities of organization of tenders and information of the applicants of available land plots.

This Act concerns rules for public procurement and the disposal of assets and arrangement for the execution and maintenance of works of public interest. Such arrangement involves the mobilisation of private sector resources for the purpose of public financing, construction, operation and maintenance of development projects or concessioning and includes financing by Build Own Operate (BOO), Build Own Transfer (BOT), Build Own Operate Transfer (BOOT) and Public Private Partnership (PPP).

The lands described in the Schedules are designated as conservation reserves with the purpose of protecting natural heritage areas and natural features on public land and preserving traditional public land uses including wildlife viewing, hunting, fishing, walking, snowshoeing, cross country skiing and boating. Furthermore, Land within a conservation reserve shall not be used for mining, commercial forest harvest, hydro-electric power development, the extraction of aggregate and peat or other industrial uses. The text consists of 2 sections and 292 Schedules.
