Implementing Land Survey and Land Cadastre Ordinance.

The present Ordinance implements the law on land survey and land cadastre of 1 March 2006. Article 1 establishes that the Land Survey Office is the competent authority. The present Ordinance consists of 29 articles divided in 7 Parts as follows: Competence and cooperation (1); Tasks and responsibilities (2); Provision and use of basic geodata (3); Real property survey (4); Discovery of property proceedings (5); Security, storage and archiving (6); Final provisions (7).

Land Demarcation Act.

The present Act lays down provisions relating to demarcation and zoning of land, especially used in the new Länder of the former German Democratic Republic where huge collective areas needed to change their boundaries. The text consists of 23 articles divided into 4 Parts as follows: Separation of land and right of use (1); Execution of land separation (2); Effects of land separation (3); Legal protection, relation to other proceedings (4).

Professional Surveyors Registration Regulations 2001.

These Regulations implement provisions of the Professional Surveyors Registration Act in relation to the application for registration as a registered surveyor or restoration of name in the register under sections 8 or 12 of the Act and to delivery of notices in writing. The Schedule to these Regulations sets out the form of application.

Recording of Documents Regulations.

These Regulations, made under section 5 of the Registrar-General (Recording of Documents) Act 1955: provide rules relative to the form of documents submitted to the Registrar-General for recording or registration; appoint authorized officers for purposes of the Act; and require the metric system to be used for measurements in documents, including survey plans. Forms for the Memorandum of mortgage, Memorandum of acquisition of land from and/or by alien and a Memorandum relative to voluntary conveyances are set out in the Schedule.

Professional Surveyors Registration Act 1996.

This Act requires surveyors to be registered with the Professional Surveyors Registration Council established as a body corporate under this Act. The Council shall be responsible for: (a) the promotion and maintenance of high technical standards among registered surveyors; (b) the exercise of disciplinary control over registered surveyors; and (c) such other matters of professional concern to registered surveyors as the Council may determine. The Act sets out qualifications for registration. The Council shall establish a Code of Conduct for registered surveyors.

Ministerial Decree No. 943 validating the Regulation on allocation of the plots of land destined for setting up and extension of protected areas of the national and local significance.

This Ministerial Decree establishes that allocation of the plots of land destined for setting up and extension of protected areas of the national and local significance shall be carried out in accordance with the programmes of development of the system of protected areas and ecological networks and natural and scientific substantiation. Land allocation decisions shall be made by provincial administration and local self-government.

Saarland Survey and Cadastre Law.

The present Law lays down provisions relating to the keeping of the land register in Saarland. Land survey as well as running the land register are both public tasks which according to article 2 of the present Law are carried out by the Cadastre, Survey and Mapping Office and other public entities. The present Law lays down provisions relating to land survey and the running of the land cadastre. Article 1 of the above-mentioned Law lists the functions of the official surveying and mapping, such as: 1) national land survey; 2) running of land cadastre; 3) conducting property surveys, including demarcation of parcel of lands; 4) producing evidence of borders; 5) providing geo-data information.

These Rules set out procedures and requirements for the conduct of surveys.The Rules provide for requirements and conditions that registered surveyors must comply with, including: survey documents to be submitted to the Chief Surveyor; testing of field equipment used for cadastral survey; abbreviations, signs and symbols to be used in survey documents; certificates; and plan forms.The Rules provide in detail procedures necessary to conduct survey of land lots and strata lots.
