This book made an attempt to bring together various legislative protections available to the tribals communities pertaining to the land and governance in the scheduled areas and the role of different institutions to achieve the goals enshrined in the Constitution. It examined the Fifth Schedule of the Constitution and its various provisions and special arrangements made for areas inhabited by Scheduled Tribes and the law relating to local self governance in these areas, primarily through village panchayat-an institution of local self governance.

This brief presents a review of 161 Intended Nationally Determined Contributions (INDCs) submitted on behalf of 188 countries3 for COP 21 to determine the extent to which Parties made clear commitments to strengthen or expand the tenure and natural resource management rights of IP/LCs as part of their climate change mitigation plans or associated adaptation actions.4 Of the 161 INDCs submitted, 131 are from countries with tropical and subtropical forests.

The present Law develops the context, principles and procedures for the right to prior consultation to Indigenous peoples or native regard to the legislative or administrative measures that directly affect them.  It is interpreted in accordance with the obligations under Convention 169 of the International Labour Organization (ILO), ratified by the Peruvian State through the Legislative Resolution 26253.

Improved access to land and data is pivotal for the promotion of land governance reform as well as the fulfillment of human rights and sustainable development. With access to reliable data and information, informed decisions regarding land and property rights can take place.

Land sector challenges are vast and complex. Insecure rights to land continues to affect more than 2 billion people living in urban and rural informality worldwide, with women, youth and indigenous people faring the worst. We need more strategic partnerships, at all levels, that drive innovative thinking and provide practical solutions to these tenure security challenges.

This report, and our campaign, is dedicated to all those individuals, communities and organisations that are bravely taking a stand to defend human rights, their land, and our environment.

207 of them were murdered last year for doing just that. On these pages we remember their names, and celebrate their activism.

And we reiterate our resolve to stand alongside those who continue the struggle for a better world and shine a light on these issues which are too often hidden from sight.

The Secretariat has the honour to present to the Human Rights Council the report of the Special Rapporteur on the rights of indigenous peoples, prepared pursuant to Council resolution 33/12. In the report the Special Rapporteur briefly refers to the activities undertaken since the submission of her last report, provides a thematic study on attacks against and the criminalization of indigenous human rights defenders and reflects on available prevention and protection measures. She concludes with recommendations on how various stakeholders can prevent violations and improve protection.

La vinculación de los pueblos indígenas al mercado global es una realidad y en ella se configuran estrategias de apropiación del conocimiento tradicional, sin que medie norma alguna que permita restituir los derechos que ostentan los poseedores de dichos conocimientos, en tanto que las poblaciones indígenas vienen solicitando un sistema sui generis para su protección y vinculación equitativa en dichos mercados.

Una de las principales demandas de los pueblos indígenas es el reconocimiento y seguridad jurídica de sus territorios. En Perú se realiza a través del otorgamiento de títulos a comunidades nativas, política que se viene dando desde la década de los setenta, pero que a la fecha no ha culminado, existiendo todavía una demanda considerable de comunidades nativas por titular.
