Water Quality Conservation Act.

The purpose of this Act is to prevent potential danger and injury to public health and the environment due to the pollution of water and to properly manage and preserve the quality of public waters, i.e. rivers, lakes, marshes, harbors, ports, coastal areas and other waters used for public purposes, and to their contiguous waterways used for public purposes and prescribed by the Ordinance of the Ministry of Environment.

Decree No. 198/2004/ND-CP on collection of land use levies.

This Decree provides for the collection of land use levies. It includes 22 articles divided into 6 Chapters. The Decree specifies in which situations the State will collect land use levies; the subjects not liable to pay (see also articles 33, 35, 50 and 87 of the Land Law No. 13/2003/QH11 of 2003); the basis for calculation of land use levies.

This Decree prescribes the implementation of the Land Law of 2003. It deals with the following matters: land price-determining methods, price brackets for assorted land categories; land use levy and land rent collection; compensation, support, resettlement when the State recovers land for use of defence or security purposes, for national interests, public interests, economic development; land inspection; sanctioning of administrative violations.

Toledo Indian Reserve Regulations.

Rules relative to occupation of land in the Reserve. Any Indian who wishes to occupy land in the Reserve may do so and may build his house thereon, by the written permission of the Commissioner of Lands and Surveys, and on payment of an occupancy fee.

Digging of Sand Rules.

The Commissioner of Lands and Surveys may, on application made to him in writing and on payment of a fee of one dollar, grant to any person a permit to dig sand on national lands. Applications for permits to dig sand shall be made to the Commissioner in the form set out in Form 1 of the Schedule hereto. Permits shall be in the form as set out in Form 2 of the Schedule hereto and shall specify, inter alia, the period of validity, the place or places where sand may be dug in respect of the permit; and the conditions subject to which the permit is issued.

National Lands (Delegation of Powers) Order.

It is provided by section 3 of the National Lands Act that the Minister may, by directions in writing delegate any of his functions in connection with the National Lands Act to the Commissioner of Lands and Survey or any other Senior Officer of the Ministry responsible for Lands, the power to sign Lease Fiats and to grant permission to mortgage leasehold interest in residential lots is hereby delegated to the Principal Lands Officer and the National Estate Section. (3 articles)

National Lands Rules.

Rules to implement provisions of the National Lands Act. Except in special cases approved by the Minister, national lands, other than town or village lots, will be disposed of only by way of grants. All mines of gold and silver and other metals and minerals, all ancient monuments, mounds or relics within the meaning of section 12 of the National Lands Act and all forest produce are strictly reserved and do not pass under the grant nor lease.

Pomona Village Land Reservation Regulations.

Rules relative to occupation of land in the Pomona Indian Reserve. So long as sufficient land is available any person who is cultivating land in the vicinity and who wishes to occupy a plot of land in the Reserve may do so and may build his house thereon, by the written permission of the Commissioner of Lands and Surveys. The Commissioner of Lands and Surveys shall have power to refuse to permit any person to occupy a plot of land in the Reserve, and may, subject to the provisions of rule 10 of these Rules, withdraw any permission which may be given.

Ramonal-Zapote Reserve Regulations.

Rules relative to occupation of land in the Ramonal-Zapote Reserve. So long as sufficient land is available, any person who wishes to occupy not more than twenty acres of land in the Ramonal-Zapote Reserve, for the purpose of growing annual crops, may do so and may build a house thereon, subject to the conditions specified in the Schedule hereto. The conditions of occupation vary according to the cultivation or use of land, e.g. sugar-cane, pasturage, permanent crops other than sugar-cane.

Circular No. 117/2004/TT-BTC guiding the implementation of the Government's Decree No. 198/2004/ND-CP on land use levy collection.

This Circular guides the land use levy collection applicable to cases defined in Decree No. 198/2004/ND-CP. Land use levy payers, non-payers of land use levies and the bases for calculation of land use levies are defined in Part A. Part B deals with the following matters: collection of land use levies upon land assignment by the State; land use levy collection upon land use purpose change; change from land lease to land assignment with the collection of land use levies; land use levy collection upon granting of land use right certificates to current land users.

Part 1 of the article 18 shall be supplemented with the following paragraph: “land belts passing nearby state frontier on land and, in case of necessity, along the shoreline of the Byelorussian part of the boundary river, lake or other water body and destined for mapping and keeping state frontier, construction of engineering and technical infrastructure, communication lines, and disposition of materiel and weapons.”
