This Act is divided into 8 Parts as follows: General (I); Possession and land register (II); Ownership (III); Servitudes (IV); Real encumbrances (V); Building leases (VI); Right of pre-emption (VII); Right of security (VIII); Implementation of Act (IX).This Law provides for real rights, their content, creation and extinguishment and is the basis for other laws regulating real rights (art. 1). Real rights are defined as "the right of ownership, restricted real rights (servitudes, real encumbrances, building leases, right of pre-emption and the right of security).

The Surveyor-General or any of his assistants have the power to demand to any person claiming to be the owner or occupier of lands or premises the production of deeds, documents or instruments upon which such person founds his claim. Said power include also the power of examining such deeds, documents and instruments.

This Act provides rules relative to the identification of borders and ownership of land.The sections of this Act are divided into 5 Chapters: General provisions (I); Survey (II); Partition of land (III); Registration and related matters (IV); Miscellaneous provisions, entry into force, and amendment of other Acts (V).The municipalities are vested with the authority to register real property and to decide on matters of partition (sect. 3). Section 4 of Chapter II deals with marking of borders.

Transfer of real estate within the boundaries of the Master Plan for Baghdad or the boundaries of the main master plans of Aqdiyas and Nahiyas attached to the Baghdad Governate of a certain type shall not be registered unless the person to whom the property is transferred was recorded in the 1957 census or any previous census in one of the regions mentioned or regions attached to the Baghdad Governate before the creation of the Sallah Al-din Governate. This rule shall not apply to transfer of property because of death. (3 sections)

The scope of the present Decree of the Ministry of Agriculture is to provide a clear picture of all land suitable for cultivation but presently not in use. Such land shall be under consideration for measures to be taken pursuant to section 8 of the Land Use Act of 1995. Municipalities shall be responsible for registration. Priority shall be given to land in good shape in areas where a lot of cultivation takes place. Position, present condition, and size shall be registered and information provided on the best possible use, suitability of the land, etc. (4 sections)

Directive No. 10/1998/CT-TTg on stepping up and completing the assignment of land and the granting of agricultural land tenure certificates.

The Directive aims at accelerating and completing the allotment of land and the granting of agricultural land tenure certificates, which was enforced by Decree No. 64-CP of 27 September 1993. All organizations and individuals that have been assigned land by the State or are directly managing and using land for agricultural production, forestry, aquaculture or salt production but have not yet been granted land tenure certificates, shall have to declare and register the total land area they are using at the commune People's Committees for consideration and granting of certificates.
