Apartment Ownership Act.

For the purposes of this Act, the objects of common ownership are a plot of land and such parts and equipment of a structure which are not part of the physical share of any apartment ownership and are not in the ownership of a third person. Immovable property ownership the object of which is a plot of land together with a structure or a structure to be built thereon may be divided into apartmentownerships. Apartment ownership is created by entry in the land register.

The Apartment Associations Act provides for differences in legal status, bases of activity and termination of apartment associations. An apartment association is a non-profit association established by apartment owners for the purpose of shared management of the legal shares of the buildings and plot of land which are part of the object of apartment ownership and representation of the sharedinterests of the members of the apartment association.

This Act makes provision for the registration of land and related matters. It also defines certain rights relating to land and the effect of registration. The Act establishes a land register, which shall comprise a register in respect of every parcel which has been adjudicated in accordance with the Land Adjudication Act, 1978 and a register of leases required to be registered by this Act. Various provisions concern leases of registered land and charges on land.

This Act makes provision for the recording of deeds, i.e. every document in writing affecting or relating to lands, tenements, or hereditaments in Montserrat. However, the Act does not apply to any document evidencing a transaction that shall be registered under the Registered Land Act. It defines the effect of the (non-) registration of deeds and concerns the proof of deeds. It also makes provision for administrative matters relating to recording and duties of recording officers.

Conveyancing Act 1913.

This Act provides rules relative to the conveyancing of land and relevant registration of transactions by the Registrar of Lands, who is appointed under this Act by the Minister. No land shall be sold, mortgaged, or leased (except for a period less than one year), or otherwise dealt with or disposed of except in accordance with this Act. The Act sets out the procedure of registration and defines duties of the Registrar.

Official Survey Act 1978.

This Act makes provision for official surveys in Norfolk Islands. The Administrator shall appoint a person to be the Surveyor-General for Norfolk Island. The Surveyor-General may from time to time redraw the Official Survey in accordance with this Act. The Act specifies details to be included in the Official Survey.

Land Administration Fees Act 1996.

This Act imposes a fee for the registration of: (a) a transfer of an estate in fee simple; (b) a transfer of a Crown lease; (c) a change or purported change in shareholding referred to in section 55C of the Land Titles Act 1996. The Act defines the method of calculation and states certain exemptions from payment.

This Act makes provision for the registration of title in land and defines effects of registration of title. The Act also provides other rules relative to dealings in land. Land in respect of which title has been registered under this Act may not be transferred, mortgaged, leased or otherwise dealt with, and an instrument that purports to deal with such land shall not be registered, except in accordance with this Act. Rights in land shall be registered with the Registrar of Titles of Norfolk Island.

Fencing Act 1913.

This Act provides for the registration of fences and provides with respect to trespass on land of cattle and other animals. Fences, whether artificial or natural, may be registered with the Registrar of Lands. Where the Registrar is satisfied that the fence would no longer effectively exclude trespass on land by quiet cattle and horses, the Registrar shall cancel the registration. An action of trespass can be lodged only if land is protected by a registered fence.

Land Administration Fees Regulations 1997.

These Regulations prescribe: fees for registration of a subdivision proposal under section 49 of the Land Titles Act for the purposes of subsection 4(7) of the Land Administration Fees Act 1996; and transactions for the purposes of paragraph 6(f) of the Land Administration Fees Act. They also prescribe fees for consultation of the Register.
