Welcome to the newly redesigned website of Legal Services of the Caribbean Community (CARICOM) Secretariat. CARICOM Law is intended to provide updated and accurate information to Member officials, Attorneys-at-Law, students and the general public regarding developments in Community law and jurisprudence.

This is an exciting time in the development of CARICOM jurisprudence. Our unique path to regional integration is reflected in our membership, our structure and Institutions, and now, the rapidly growing body of Community law, expressed in our legal Instruments, Community decisions and Court judgments.

This site comprises a database of all Community instruments – treaties, agreements and other legal documents – as well as national legislation submitted by our Members. Our newsletter, CARICOM Chambers Quarterly (CCQ), will be continued to be published online at this site.

In addition to the freely available information and legal resource materials, CARICOM Law will be an important working tool for the Community in the review and preparation of legal instruments, with facilities for registered users including discussion fora and access to restricted documents.

Land Registration Act.

This Act makes provision for the registration of the ownership of land, lease and other title to land, and for this, and other purposes, establishes the Land Registry.

Caves Act.

This Act concerns control by the Minister responsible for the environment of operations in caves declared to be a cave for purposes of this Act by the Minister. The Act also allows compulsorily acquisition by the Crown of any land required by a public company called the Caves of Barbados Ltd. (“Company”) for the development of a cave. The Minister may give directions to the Company and the Company shall submit yearly an Environmental Management Plan to the Minister.

Land Acquisition Act.

This Act makes provision for the compulsory acquisition of land for public purposes. The Act sets out the conditions and procedures for land to be acquired by the State for purposes for which the Crown is authorized to acquire land by law or any other purpose that the Minister deems to be a public purpose. The Act also concerns abandonment of acquisition and appeal against decisions regarding acquisition

Judicial Sale of Land Act.

This Act makes provision in relation to the sale of land ordered to be sold by the High Court and related matters such as valuation of land by appointed appraisers. Procedures of sale shall be handled by the Registrar of Titles. When any land ordered to be sold by the High Court remains unsold for one year, then the holder of any lien against the land or any person entitled to any estate, right or interest in such land or the holder of a specified registered debt certificate may apply to the Registrar requiring the sale of the land at public auction.

Land (Adjudication of Rights and Interests) Act.

This Act makes provision for the adjudication of claims to title to land and rights and interests in land by a Commissioner appointed for this purpose by the Governor-General under this Act. A Commissioner of Titles shall handle claims regarding title in land situated in the registration district for which the Commissioner is appointed and shall exercise general supervisory control over all adjudications. The Commissioner shall adjudicate claims regarding ownership, lease, encumbrances, decisions of the Chief Surveyor or entries of a Registration Officer.
