This Act provides for the efficient management of land and the protection of ownership by registering the information concerning land in a cadastral record and managing it after conducting its survey and measurement, and by prescribing the matters related to the furnishing of registered information. The Act consists of 54 articles divided into 7 Chapters: General provisions (I); Cadastral record (II); Application for land alteration and cadastral adjustment (III); Cadastral survey (IV); Registration, etc.

Alienation of Land – Property (Chapter 02 of Title 37).

This Chapter provides in respect of certain matters relative to the sale, gift, exchange, or any other method of disposal of land. There is created a Land Commission which shall endeavour to prevent the monopolistic ownership of land and undesired alienations of communal lands by those charged with the management and control thereof. For this purpose the Commission shall make recommendations to the Governor respecting the approval or disapproval of instruments affecting the title, ownership or possession of land which require approval of the Governor pursuant to section 4.

This Chapter provides for certain matters relating to title in land. The owner of any land in American Samoa, not previously registered, may register his or her title thereto with the Territorial Registrar, but no title shall be registered unless the Registrar is satisfied that there is no conflicting claim thereto and unless the description clearly identifies the boundaries of the land. Every registration shall specify whether the land is registered as family owned communal land or individually owned land.

The senior matai in charge of communal lands belonging to his family, or the male members of the family owning and residing on communal lands, or the owner of individually owned lands or freehold lands, shall have the power and authority, as limited by this Chapter, to agree with any person that any structure now existing or hereinafter erected on such lands shall not be or become a part of the real estate, but shall remain separate and distinct therefrom, subject to ownership separate from the land, and also subject to the right of removal by the owner of the structure.

La presente Ley tiene como finalidad la protección, el fomento y el desarrollo de las comunidades indígenas. El título II (arts. 12-22) se ocupa de manera particular del reconocimiento y protección de las tierras indígenas. A efectos de esta Ley son tierras indígenas aquellas que las personas o comunidades indígenas actualmente ocupan en propiedad o posesión históricamente, o bien en virtud de los títulos indicados en el artículo 12, así como las que los indígenas o sus comunidades reciban a título gratuito del Estado.

An Act to provide for the validation of a replacement register of native lands for Nikunau. The principal object of this Act is to enable the Government to establish a Land Commission which shall undertake to compile a replacement Register of Native Lands for Nikunau which has been destroyed. Section 3 imposes certain duties on the Commission when compiling the replacement register. Section 5 provides for the inspection of such register by villagers. Section 6 enables any person to raise any objection to or claim for inclusion of title in the replacement Register.

From the records or judgment, or order or decision of various specified courts, a Commission appointed under section 3 shall compile a replacement Register of native lands recording therein all titles to native lands, pits, ponds, fish traps and sea walls in South Tarawa. The Register shall be open for inspection by the villagers, who may raise objections and lodge claims with respect to matters regarding inclusion of title in the replacement Register of Native Lands.

Land (Tenure Conversion) Regulation 1964.

For the purposes of Section 7 of the Land (Tenure Conversion) Act, an application for registration shall be in the form in the Schedule to this Regulation. Subject to this Act, a citizen may apply to the Commission in the prescribed form for registration in his or its name of any customary land or of an interest in customary land.

This Regulation implements provisions of the Land Registration Act with respect to documentation of procedures for the registration of titles in land. Regulation 3 sets out general requirements for documents lodged with the Registrar. A State lease shall be prepared on suitable material of a quality approved by the Registrar, and in accordance with the requirements of the Act.
