WEBSITE ABSTRACT: This thematic study explores the possibilities for strengthening the recognition of customary tenure in Vietnam. It begins with an overview of customary tenure in Vietnam, particularly in upland forest areas where customary systems still prevail. In upland areas, forest land allocation policies have been underway since the 1990s to claim back forest land from unproductive state-owned forest enterprises (SFEs) for redistribution to local forest users.

ABSTRACTED FROM WEBSITE INTRODUCTION: This thematic study explores the importance of customary tenure for rural Cambodians with the aim of strengthening its recognition. It begins with an overview of customary arrangements in the country, and their significance for the livelihoods and wellbeing of rural communities. This is followed by a discussion of the recognition of customary tenure in the Cambodian legal system, and the challenges confronted in the implementation of legal provisions.

This paper discusses Cambodia’s legal framework relating to Economic Land Concessions (ELCs) and looks at the implementation gaps. It argues that despite Cambodian’s legal framework governing land and ELCs being well-developed, its social benefits, such as protecting the rights of the poor and vulnerable and contributing to transparency and accountability, are almost non-existent.

Statutory recognition of rural communities as collective owners of their lands is substantial, expanding, and an increasingly accepted element of property relations. The conventional meaning of property in land itself is changing, allowing for a greater diversity of attributes without impairing legal protection.

Contains introduction: property rights, inheritance, and HIV; the impact on development; challenging the roots of the problem; modern laws and individual rights: do they always support women?; pinpointing the difficulties with the existing legal frameworks; ways forward.

Includes background to women’s land rights in Zambia; policy and legal reforms of the1990s; key findings – gender insensitivity on land laws and policies, the high cost of legal fees to handle land disputes, the limited benefits of title deeds for women, lack of awareness on land policy process, land grabbing and disinheritance, lack of security of tenure, lack of access to justice; conclusions and recommendations.

A critical analysis of the draft Land Policy. Contains introduction, land delivery system and accessibility to land, title deeds on customary land, vestment of land, land market, gender issues, allocation to foreigners (with particular reference to white farmers from Zimbabwe), dispute resolution, land management information systems, concluding remarks.

Includes learning from the commercial sector – freehold title deeds, pre-1980-2010; learning from Zimbabwean customary tenure systems; learning from the state resettlement programme – permit tenure, 1980-2010; fast track land reform, 2000-2010, policy implications and recommendations.

Addresses the research question, do different land tenure conditions affect farming systems, organisation and performance among Zambian small farmers, and if so, how? Discusses the widespread demand for title, even on customary lands, and concludes that this is a defensive measure, based on a desire for secure possession and for bequeathment and the protection of fixed investments.
