The Minister may declare a port or any waters of Papua New Guinea and any land contiguous to such waters, to be a declared port for the purposes of this Act. The Papua New Guinea Harbours Board is established under section 3. The Board shall give effect to any direction given to it by the Minister on any matter of policy relating to the exercise or performance of its functions, duties or powers. The Board shall be responsible for the regulation, management, operation and control of declared ports. The functions of the Board are, within a declared port shall be to control and regulate all waters and the use of all waters; to carry out port activities, to regulate navigation, etc. The Board shall have also certain functions outside of declared ports. The Minister responsible for land matters shall grant to the Board special purposes leases under the Land Act 1996 over the land in the declared ports to which this section applies that, immediately before that date, was, in the opinion of that Minister, used by the Board for port purposes. The Minister responsible for land matters may grant to the Board further leases under the Land Act 1996 over any land within the limits of a declared port that is required by the Board for the purposes of this Act. A Port Advisory Committees are established for each declared port.
