The Preamble of this Act declares the purposes of the enactment of new provisions relating to the ownership of land to be: (a) to alleviate the consequences of some injuries suffered by the owners of agrarian and forest property in the period of 1948 to 1989; (b) to provide conditions for improvement in the care of farm and forest land through renewing the original relations of ownership of land; and (c) to create conditions in accordance with the need of economic development of rural regions and in accordance with requirements for landscape and environment conservation and management.The text of this Act consists of 34 sections which are divided into 4 Parts: The range and applicability of the Act (1); The entitled persons (2); The Land Funds (3); Special, temporary and concluding provisions (4). The Act is to regulate the rights and duties of the owners, the original owners, the users and leaseholders of land, and the role of the state in regulating the rights of ownership (subsect. 1(2)). Agricultural land includes forest land (subsect. 1(1)). Entitled persons are citizens of the Czech and Slovak Republic with domicile in the CSFR, whose farmland or structures were transferred to the ownership of the state during the period of 25 February 1948 until 1 January 1990, the transfer having taken place in any of the ways enumerated under section 6, or their heirs (sect. 4). Land in ownership of the State shall be returned to entitled persons (sect. 6). Land shall not be returned to the original owner in circumstances a described in section 11. Real estate in state ownership referred to in subsection 1(1) shall be managed by local bodies called "Land Funds" (sect. 17). Provisions of part 4 provide for the right of replacement of livestock contributed to collective farms and compensations for removal of buildings and perennial crops. Various sections of this Act deal with leasehold, rights of usage, and servitude.
