This Act provides rules for physical planning, including Integrated Urban Areas and Town Development Planning, in Marsabit County. County plans shall be made in accordance with provisions of Part XI of the County Governments Act, 2012. This Act prescribes content of county physical development plan and creates a county planning unit which within the county government and a county planning unit. The functions of the county planning unit shall include - coordination of integrated development planning within the county; ensure integrated planning within the county; ensuring linkages between county plans and the national planning framework; and ensure meaningful engagement of citizens in the planning process; hearing and determining appeals lodged by persons aggrieved by the decision of any sub county planning unit; determining and resolving planning matters referred to it by any of the sub county planning units; advising the county executive.The Act also provide for development permission, procedures of approval of a County Integrated Development Plan, County Sectoral Plans, County Spatial Plans, Urban Areas Plans, (including objections), public participation, and integrated development planning. County plans shall be based on relevant national policies. Integrated planning shall take into account, among other things, environment, disaster preparedness and response, and services, and shall provide a framework for regulated urban agriculture. As for public participation, this shall be mandatory and in the process information on environmental impact assessment shall be provided.
